There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?

I agree with your opinion however we might be in the minority here, fellow members(some of them) are just concerned about getting an EAD and AP. They do now know the issues we face after that. Every year renewals, associated risk of not getting AP in time to travel out and not to metion that fact that this will definitely add to the waiting period indefinitely again unless we get together and initiate a campaign for
1. Recapturing unused visa numbers from past years
2. Getting USCIS to treat Primary + Derivatives as one Visa number rather than individual.

How about they don't count dependent children under maybe 14 to the annual quota. They don't need EADs and they will not compete for jobs with anyone for a long time.

First off, i have mentioned above that this is NOT a solution to retrogression. Secondly, the USCIS does not care what we say to them, they are going to take exactly how much time they want to take to process our Green cards. All I was suggesting was, we ask for interim relief. Now like Logiclife mentioned we are trying for smaller bits of interim relief and that is a reasonable answer. However please do not make remarks like "this person is here to make money and is not after GC". Are we not all after making money? Is that not why we want GCs? We certainly dont want the GC to frame it and keep it next to our other trophies do we? Then why are people accusing me of wanting to "make money"? The problem with some people on this forum is the lack of respect for an alternate view. It is one thing to disagree and it is another to make ridiculous off topic remarks about what someone said.
Getting a GC will ensure that you can sustain your money making efforts in the USA. By getting diverted to interim relief for spouse, people will be able to make money, but not for too long without a GC. That's why the focus should be on an action that permanently fixes the situation, rather than a band-aid approach.

I predict the movement of PD for april'07 will be significant for EB2 India, EB3 ROW for sure. They would not hold up everyone in EB2 India, EB3 ROW at the current priority dates.

Also, in the do_not _register_to_vote point, add: One should not even verbally claim that they are a US Citizen (obviously especially when you are dealing with law enforcement, state and federal agencies). If proven it would essentially strip one of the GC status, make ineligible for naturalization and all set to be in line for deportation.
Secondly, add the point about updating the I-9 if you are employed.
That said, with the AC21 portability, once an employee is working in the sponsor company for more than 180 days after I-485 filing (and possibly years before that) the issue of staying on with the sponsor for 6 months to 1 year is a completely moot point!
Unless I need to show it in travel or elsewhere, I never carry my GC with me at any time, nor will I in the future until I see exceptional enforcement on this. As you mentioned there is a law on this but it letter of law is a bit debatable. Several of us are not sure if our early July applications will be accepted or rejected (although common-sense says that a rejected application should be back in our hands by now, who can predict the system anymore).

The guy who initiated this conversation came here nearly more than 3 months back, has just 5 posts but a ton of energy to fight with US employers. Starts a topic, and we are all getting diverted in posting in this thread.
I definitely support complaining against anyone who breaks the lawy, be it employer, or employee.
In this case the guys as he "claims" appears to have come here without employer calling him. And is trying to complain against. Who will be screwed up. The employer can easily say he anticipated, but no project no, so didnt get the guy to US, as its legally allowed not to get.
Again, I STRONGLY feel this thread, and the similar, are all in an effort to divert our attention. Just stop these by not bumping them, with our comments. Let mine be the last.

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.
I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.
I need to clarify a few things before i nail these blood suckers
1. How long before i board my flight back home , should i send the documents to DOL
2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
or copy to send to DOL
3. What other documents should i send alongwith
4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.
5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.
I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.
Any advices are welcome to help me bring these guys to justice.

If we had stayed back in india, we don't have have to do any of these.:rolleyes::confused: . After GC also no freedom. As one of my american co-worker was telling, In America only the statue of liberty has the freedom.
The mistaken notion "GC = freedom" seems so pervasive that I am also tempted to take a whack at this much maligned equation. Lot of anguish can be spared by keeping our expectation from this 3" X 2" plastic somewhat grounded in reality. There is no denying that having GC makes life easier than before, specifically by opening up more job/career opportunities. But these have nothing to do with the constitutional freedom that you presumably allude to with your Statue of Liberty analogy (I should say though, as a metaphor this quote of your colleague is pretty lame). Not only GC does not give us the right to vote, it cannot even protect us from deportation risk on relatively minor legal grounds (http://www.nytimes.com/2008/04/12/us/12naturalize.html?_r=1). It is perhaps wise to remind ourselves that GC is a privilege (http://www.wr.org/media/pdf/immigrationassistance/permanentresident.pdf), not a right.

Yes, I totally agree with you. So far, besides the SR that was opened by my attorney, I have done everything on my own. When I called my attorney a couple days back, he asked me why I was in such a rush..... I would love to see him wait for 13 years for something. Coincidentally, I was told the same thing by the IO this morning...."give it some time, we responded to your inquiry, it will take 60 days. call us after November 15th "".
When will I see light at the end of the tunnel? :mad:

There is obviously no insight, memo or communication that USCIS ever provided to us, this is the first time that we even heard from USCIS(That too thru a Senator) on real number. All you can do is make a guess....
Until 2005 we didn't know the word retrogression, so majority of Indians filed under EB-3. So I have distributed 2002, 2003 & 2004 evenly. then gave small EB-3 numbers to 2005/2006
It was in the middle of 2005 was when retrogression actually started or was warned by Lawyesrs(it actually started in oct-nov2005 I don't exactly remember). So people started filling only under EB-2....Since lot of 2004 cases have already been cleared, I put 10K in 2004 and evenly put 20K in 2005/2006...

In any case, why should someone be SO disturbed if some lawyer says "I will try to prove your degree equivalency for trying to get into EB2"?

My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

Doesnt consulting clause remove most of the Indian companies from the picture anyways?
May be US corporations can tactically support this bill because this bill will impact Indian bodyshoppers severly. For past 5 years US companies could not compete with Indian companies as they have more leverage on H1b. Now if Indian companies avoid H1b US companies can get any time they want as they can satisfy most of conditions
