It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....
Any suggestion in this regard is highly appreciated !!!!
Your application may be just sitting in their shelf because of name hits. The "in process" letter that FBI sends doesn't indicate much. Depending on how popular one's name is one might be in the namecheck hole for 4+ years.

Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

Many people with legit US education (not TVU kind that many not so educated people on this forum are taking shelter under the umbra of) who have been in the US for more than 10 years are still lawfully waiting in the line. And this idiot with a BCOM and MCA ( correspondence course from IGNOU) is dreaming of porting into EB2 and screw us up. Shame on USCIS and Shame on DOL. I am really concerned that if legit EB2 applicants don't talk to lawmakers and send emails to USCIS, we will be stuck here for years due to these fradulent porting.

Most of the people on Immigration Voice come here for legal advice regarding immigration, what if IV negotiates a good rate with 3-4 Immigration attorneys and recommends those attorneys to members? Attorneys would get business due to IV recommendation, IV will get referral fee ($100-$200) per referral and members will get discounted rates from good attorneys.

Thanks guys for the moral support and quick responses.
More details are as follows:
1. This accident occurred in 18 months back in CA
2. We were going on high way and suddenly the car infront of me came to a sudden halt and as I didn't had any reaction time, even though I applied brakes I went and rammed into the van in front of me, which in turn hit the car infront (like a ripple effect) and totally 8 cars were involved in that collision.
3. So at first we thought it is entirely my fault as I was coming at 50s and I rear ended the care which inturn created this ripple effect.
4. But the actual scenario is, the van infront of me came to halt, as it rear ended the car infront of it and due to which the other car hit the one infront.
So already one accident happened and I caused one more and as mine was a 11 seater and coming at 50s the impact was high and involved in 8 cars.
All this happened within in mins or secs, I would say
--> --> --> --> --> --> --> -->
Myself car1 car2 car3 car4 car5 car6 car7
In the above pictorial representation,
a) car 1 hit car2 which in turn hit car3 (1st impact)
b) Myself hit car1 again which ripple effected all the way upto car7 (2nd one)
I was the only person injured and and had to be hospitalized with bi-lateral hip fractures and right knee fractures and was out of work for 4 months.Luickly my insurance covered most of the amount thats been charged(around 300K)
Finally I recovered to a great extent and out of blue gets a lawsuit from the owner of car3 against myself, Car1 and car2.
BTW, insurance determined that my fault is 80% as I caused the greater collision and they paid the property damages for all the cars involved.
As per the lawsuit, seems car3 drivers spouse had herniated disc due to this accident and are expecting $200,000 for future treatment
So they are claiming the following:
3 milliion for : other damages(emotional etc.....)
200,0000 for: future treatment
50,000 for: lost wages
Thats is what the story of my life :(

Growing up I use to goto an organization wearing kakhi-chaddi, so I grow up hating Mahtma Gandhi (but that ws long time ago),
I now has so much respect for this Man, I wonder how was he able to cheer and integrate my fellow Desi's ;) almost 60-80 years ago, if I think about it now seems almost like a miracle.
We really need to look into his life and find some answeres, as we have long battle and it is just getting started

Hello All,
I am also in the similar suituation.
Left company A and joined company B(H1B transfer approved), Company B applied for I140 using labor substitute.
But when i am checking my previous company A's H1b status it is showing 'The case is reopened'.
I am very much worried about the same.

How about start or finish the rally with US National Anthem ?
This will get a lot of attention. Above all it will show 'Legal Immigrants' different + communicate a lot.
Also encourage to get more American friends.
You can have a beer after the rally !

You are right in that the donation would go towards the core IV funds. But if we resort to writing personal checks and What if it is short of the amount he spent ? Should he wait for months if not years to realize the amount he spent ? I think they should be compensated immediately from the core IV funds.
The donations that we make to IV will be part of the general corpus which will be used for lobbying. As one core member pointed out 99% of that fund is utilized for lobbying, I am guessing remaining 1% is spent on hosting IV website.
If you guys want to help Aman we could write a personal check favoring Aman. What do you guys think?

Yesterday, I got RFE for myself and my husband and need to respond by April 29th.
On my husband's 485 application we entered Last Entry Date wrong, they asked for the proof for the same and all I-797 issued to him so far. We have all his I-797 approvals and he was never out of status, but just worried that we put wrong date for Last entry Date.
I have sent the RFE to my attorney, waiting to hear his response. I am really worried what it could mean, not sure if it is a big thing or a simple RFE, need your advice.
For myself they have asked for I-797 approvals to show valid employment authorizations with the company from April 2004 - Deceber 2006.
I also have another question, my husband is on EAD since last year. Our 6 years on H1 are expiring in June 2009. Can he get H1 for the period he was on EAD?
Please advice.

This is an excellent question and I was also looking for an answer. I am into my 6th year of H1-B(exactly 5 years 1 month) and also have an approved EAD & AP.
I have a great JOB offer but hesitating to invoke AC21(moving using H1-B/EAD) because these days there are many 485 DENIALS( the moment I1-40 is REVOKED). And NOTHING is guaranteed even if we send the AC21 documents to USCIS. And the EAD automatically gets invalid anyways when the 485 is denied.
Doing some research to find out if H1-B extension beyond 6th year is valid if 485 - gets DENIED? (Example: If I get a 3 year H1-B extension based on my current I-140 approval)?
Also not sure if it applies in my case as I still have 10-11 months of H1-B remaining and if I decide to take up this oppurtunity in the next couple of months and 485 gets DENIED after that. May be I will have enough time to file MTR? I should be fine. But what if 485 gets DENIED after I complete 6 years?

My first EB-3 labor was filed in Dec 2001 (Non-RIR) but employer withdrew it because of lay-offs. Employer filed again in Nov'03 (Non-RIR again) and it was approved in March 2007 (after RIR conversion in Jan 2007) by Dallas BEC, followed by I-140 approval (March 2007) and I-485 filing in July 2007. Though my job required a MS degree, my employer could not file in EB-2 as there were people in my team with just Bachelors degree when they joined the company 10-15 yrs ago and lawyer did not advise employer to file in EB-2 as EB-3 was current those days......After surviving 12 rounds of lay-offs, no job security whatsoever throughout and fed up with EB3 process, I changed jobs after 8.5 yrs (July 2009) and my new job required a minimum of MS + 6 yrs of experience and fortunately my new employer (another large company) had no issues re-starting the process again. I work in Mobile Communications R&D (developing networks which support smart phones (2G/3G and now 4G-LTE technology) have been in this field since Jan 2001) and here are my EB-2 case details:
Joined new employer in July 2009
PERM Prep work took 6 months
EB2 PERM filed: March 30th, 2010 (MS + 6 yrs or BS + 8 yrs as min requirements)

- Vermont and California process EB based 485 applications. (So if the data is for 485 then there should have been columns for Vermont, California service center.)
- The table provided in the letter says "Pending EB applications from India".. in my communications with my attorney, the term "EB (visa) Application" was mostly referred to filing of i140 in EB category.

It is not an easy or trivial task to "just move on" and pursue plan B or plan C.
True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.
With passage of time, the priorities and the drive of people change.
Given the passage of time priorities/drive should be geared more towards securing and making the best of what you have (home country's citizenship) rather than what you don't have (GC). Heck, even retirement based mutual funds work in that fashion (aggressive at first, conservative as time passes).
So, the immigration system should be quick and transparent.
No offense but it comes out a bit narcissist like ... don't ya think?

You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)

What you said is 200% correct, I am also using their service from past 6 months, they are the best I have seen in Govt sector so far....ICICI bank is really verst in terms of every thing except global custeomer care....
I have stopped using ICICI year ago...Guys better use onlinesbi.com/gls, better exchange rates....

What i'm talking is "SBI Direct Remit" & takes 3-4 business days but just click of computer mouse once you are set up. I actually set it up Monday morning EST and Friday Morning EST i see my money at Foreign account. No need to open a account at SBI-NY or anywhere but its good to have the target account at SBI ( it can be your mom/dad's SBI a/c or yours , doesn't matter really )

P.S: By the way - i also had the idea that SBI is "sarkari bank" - slow , unprofessional etc... etc.. But the band of peoples who handles this division are really young and bright - my experience for last 6 months is just terrific. Customer Serivice also replies via email the next morning ...
