Not true...
In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.
If they dont count Dependents we all get GCs very soon . Unfortunately all dependents even kids are counted under employement category ..
One change - Counting a number for primary applicant can change thousands of lifes each year .

Here are the few main reasons for retrogression to India and China etc are
1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.
2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.
We need to educate the USCIS why and how we are suffering in getting GC.
there is no need and use of blaming Desi companies. I do not support any illegal activities like sale of Labour certifications .
We all know about supply and demand theory which causes black marketing.
Selling of approved labour ( which has old PD ) is also same thing.

Since Visa numbers trickle down, the more visa numbers there are available, the more will trickle down to countries with high demand... recapturing visa numbers might be easier than taking a poke at per country limit.. IMHO...
Recapturing lost numbers is not a permanent solution. Per country limit 7% is ridiculous. We need to make sure we are not discriminated against by the per country limit. Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

Looks like most of 2004 cases are getting approvals.
Congrats on getting physical card caliguy--today even both of us got our CPO emails. :D.
Your posts along with alterego, kabmilegaGC and others ..were quite helpful. Ironically, in the entire time, since GC process began , it is only last 2 months that were most stressful but rest of the time, I didn't even care when dates will become current etc.etc..was just going with flow. I wouldn't want to repeat time from Aug 10th to Nov 2nd.--just waiting, waiting and waiting..and nothing happening.
If USCIS becomes more transparent and follows FIFO strictly.then that itself will give lot of relief to waiting applicants.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.
The Form for instructions for filling the complaint & the form is available at http://www.dol.gov/esa/whd/forms/fts_wh4.htm list of H-1B willful violators is available at http://www.dol.gov/esa/whd/immigration/H1BWillfulViolator.htm and the list of debarred employer's is http://www.dol.gov/esa/whd/immigration/H1BDebarment.htm
When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.
What exactly happens to them?
Are they under a watch list?
Many employers will open up a new company and operate?
Maybe employers are ready to deal with this ????

For my wife's passport we got it after two days because VFS handed the passport to Blue Dart after the cut off time at Chennai. We had our interview on 7th of Dec and we got our PP's on 20th and 22nd. I would not recommend any changes to the airline tickets until you get your PP in hand.

(1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I am better than him because I will go to India and not canada. I will stop short of saying that every one should go back to India or his/her homeland.

I am 2nd July filer and till date i did not receive Advance Parole,but my wife received an approval notice from USCIS stating that they approved her AP(but AP not received) .
And Today i got an email from USCIS guys stating that my file for AP is under "Name Check and Background Check"..???????
I just want to know from IV members how much time it will take to get clearance from background check as i have an emergency to go Home country. confused::mad::mad::(:(

Let us use this weekend to get on the phone and spend an average of 1 min. 20 seconds per Representative leaving voice mail messages per this script. It is absolutely easy. There can be no reason we cannot do it.
For each Immigrant In The Queue, remember, you can call, so can your wife, so can each of your kids. Get a friend to call. Get his wife, or her husband to call. 57 is pathetically low. If each of us that have called gets ONE MORE PERSON to spend a grand total of 10 Minutes leaving voicemails, we will have hit the 100 mark.
Guys, gals and other beings... this is not scary stuff. You will be 'talking' to voicemail. Time much better spent than debating the LA Lakers-Celtics game, wondering about what to eat for lunch, or debating the latest controversy thats caught your fancy.
Seriously, let the HIGH SKILLS portion of our profile come to play ... pick up the phone and call ... call now !!!!
