Does someone have an experience of application process, so that i send in the right papers, before leaving here. i mean the set of documents to send to DOL, so that i do not miss out on something important which could nail him to the maximum
I suggest to focus on getting a job and you can nail him any time later.

Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

Do you guys think it make sense to buy a Flat/Single family house in India , I am going to india in Mid october. Should i take the lunge and buy some proerty there...This would be the first home..so no Home equity Loan..It will be on 12% interest Rae from some indian bank.
Please throw some ideas..

It seems like any change in the immigration system is only going to land us in a worst position than we are in....
And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.
Any noise we make seems to be making our opponents solidify and press us even harder.
I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.
My suggestion - You can not play safe your whole life.
After an extensive research on internet about all this I will expose my case to hear your opinion.
I'm on my EAD second renewal now, Have approved I-140 and my PD is Dec 16/2006. Si according to waht you say I can walk away changing emplyers and get another job or either a part time job???
My current attorney wont give me any advices because she says is against the law because she represents my employer and me so she recomends to look for another attorney.
Since I have an EAD my wife was able to work and things turned better but this year with the economic situation and a baby I'm about 5k short and I'm being very careful and looking for a wild card just in case.. Someone told me I can get another H1B and start over even If I have passed the 6 years of H1B.
Any thoughts?

There is a difference between H1B Visa/AP and I797/EAD.
The first one is a travel document. That is all it is good for.
The second one is for employability proof. That is all this one is good for.
Each one has some restrictions. As long as you are not violating any of the provisions under which you were issued a visa/AP/I797/EAD, they will be good.
So... if you are working on a H1 (I797), going out of the country and returning by using AP will not make you lose your H1 as long as you continue to work full time for the sponsoring company.
As far as the company is concerned, your work eligibility status is based on what you provide to them when you fill out the I9 form.

EAD & AP is luxury & aggressive. Keeping H1B active is being conservative and playing with probability and backup. It depends on your nature. Go for it!!
If you are planning on a big investment like buying a home or something like that. It is better to stay on H1B so you have a backup if something goes wrong with GC.
I have seen problems with cases using AC21 when they apply it asking for more details and also sometimes ur I-140 is revoked by your sponsoring employer and USCIS may trigger a NOID for you. Ofcoourse you can file MTR and prove that them that it is legitimate to change jobs using AC21, but if you have H1B also then you have a piece of mind.
Also for the first job change use AC21 and do H1B transfer also and see for 6 months so that USCIS is already aware that you ve changed company. You can address any RFE/NOID. But later on you are on ur own.

Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?
