Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?

Ok so it's september already and you got your FP! But you want to have a total period of 1 year without losing your pd or your file in queue.
If dates are current in August then rescheduling september FP will go to December/November at the best!
Then you complete the fp process and the average time is 8 months - considering the flood of applications and dates will definately hit retrogressing in Nov-dec, They will assign cut-off dates. lets assume they go back to where the dates were in May/June 07 , then ,you will need to see where you are in the queue. There are some creative ways of generating an RFE (without getting 485 rehected due to initial evidence)- but it's not recommended ;-).

You have to see my quote from the context of immigration. I never said illegal immigrants do not have any rights. Human rights are across the board. Every nation must follow these standards. Illegal immigrants can not sneak into a country and then demand that they should be given citizenship.
Regarding undocumented workers filing with EEOC, please quote me few cases like that. I doubt if it is ever possible. In my personal opinion, when such workers are subject to deportation when found, where is the foundation in that case? Are you suggesting that non-citizens can apply for jobs in defence and aviation and complain to EEOC if rejected?
Again this could be looked at from many angles. The right to march and demand citizenship is protected under the 1st ammendment. Whether they get the citizenship or not is another issue but indeed yes, as ridiculous as it is, one is free to have the audacity to make statements that may be ridiculous in nature and that is their right under the 1st ammendment to do so as long as they are within the borders of the US. It is these types of freedoms that distinguish America from many other countries, to the extent to where even a person subject to deportation has the right to due process. The 1st ammendment guarantees the freedom of expression. Freedom of expression further covers the right to free speech, press, assembly and to petition the government for a redress of grievances (which is what the undocumented are doing in any case) etc [more here (http://www.law.cornell.edu/wex/index.php/First_amendment)]
Indeed a Federal District court has already ruled that immigration status is not a matter that is debatable in a EEOC/discrimination law suit. If the below is not sufficient there are some actual cases involving undocumented workers who were not victims of human trafficking.

"We are pleased with the court's order because Title VII's protections against discrimination apply to all employees whether they are documented or undocumented," Burnside said. If you read my other post correctly, it said the exemption was with security clearance related jobs. The two types of jobs you cited more than likely require security clearance but if they do not then its fair game for a discrimination complaint. Security clearance is only available to US citizens. My point is that if an employer with more than 4 employees whose job offering does not require security clearance or does not touch on matters of national security has a job posting claiming 'US Citizens Only' and an eligible for work non US citizen eg Green Card Holder or H1-B, EAD holder applies and is rejected primarily on the basis of their national origin or immigration status then yes, they do have credible grounds upon which to file an EEOC complaint. Note that an employer is only supposed to ask for documents that identify eligibility to work when they have made the decision to hire and are filing out form I-9. For instance there is already a case where EEOC or the DOJ won a case because an employer insisted on seeing an employee's GC and would not take an EAD. In summary, I'm not suggesting, it is the law and I believe I have given references to the relevant sections in my other post. But if in doubt, you may want to check with a lawyer and not take my word for it since I'm not one.

Another intresting update...
I just checked the USCIS website and found out that the approved H1 which has been reopened has a Last Updated date of 09/30/2007....
09/30/2007 was a Sunday...why is USCIS working on the case on Sunday ???

OK, coming to the point, how did you open 2nd SR within a week. Did you get any response for the 1st SR or 2nd SR at all? If so, what was it?
Did the senator's contact help you at all?
What did u ask when you went for the infopass?
What do you think, that could have triggered CPO? May be your rep at the infopass sent an email to NSC?

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

I think, we should start another flower campaign for Condi....she too deserves to be bombarded with flowers....I was appalled listening to her views/opinions TV on the July visa bulletin fiasco....

Does someone have an experience of application process, so that i send in the right papers, before leaving here. i mean the set of documents to send to DOL, so that i do not miss out on something important which could nail him to the maximum
If you really want to hit him hard call ICE as well and let them know. If there are similar testimonials from several employees, he is done

I do not agree with the premise that 'IV agenda does not have any benefit for H-4 problem'. Once the larger issue of retrogression is solved, it will solve the H-4 problem also. As a matter of fact, me and a lot of active members are interested in the H-4 issue that is directly affecting us. But I believe that addressing the core of the problem here is what is necessary and that is what IV is pursuing.

I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surprised today since nothing was ever said regarding no interest in the H-4 cause when many discussions were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributor to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT 'spouses' folks, so for this folks the fight for better legal provisions still on, good luck to you!.

Bashing the system and correcting the imbalances are correct. But some people in this forum are targetting individual persons(some times Senators) and doing personal attacks some times bad words also(I can see atleast 100 postings like that). No one realise the fact that same right we were not able to get in our own country. Can anyone talk to MLA or MP in India by phone when they want if any issue?. So we need to appreciate that we got extra freedom than our own country. If we want to correct problems in the system we have to fight with patient with point in mind that we are aliens compared to those who came here 20 years or 100 years before us.
Everyone on this forum or at least most of us on the forum know what are the downsides in indian system. Every one can write thousands of pages . I agree with you that India has problems and I am the first one to agree.
The momemt one starts comparing both countries , It is a race to bottom. Hope you understand.
At least personally I have so much respect for the system. Dont think that who questions an unfair system is less appreciative of USA.

I am taxed every month for social security though I am not eligible for any of those benifits as of yet. I always thought if that is the price I have to pay to make America my home I thought I would do that happily.
I still have beleif in the system and hopefully something better comes out .
I am just writing this email to complete my civic responsibility and If I dont speak out nobody will speak on my behalf.
I would appreciate if you can educate some people like your dad ...

I talked about this IV to lots of my immigrant friends who are in different stages of GC processing. I feel those folks are thinking of getting a free ride with others contributions and hard work. I can only pity them for not being a part of the team. This kind of character would get them GC but would not get them to top in any profession. Still I did not lose my heart. I will keep on talking about IV with them and I beleive, one day they will feel to contribute.

And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief.

What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
If one shows more loyalty than that shown by that entity, then one is a fool. That entity could be a country, party, company, spouse.
Right now, one entity (US government) is not showing much interest in our condition. That level of loyalty should be reciprocated but no more.
