IT IS AS SIMPLE AS THIS ----
IV has to convince the government that this mess was created because close to 100000 visas were WASTED/UnUsed while BEC was busy(or not busy) sorting through the cases. If it is the mistake of a govt department, then the govt should fix it by recapturing these visas. They will act only when you make them look bad or file a suit against them. Why hasn't IV been able to push a simple argument like this????

Do we really have to ask for the person who handles legislative and immigration matters or it is ok to leave message to the person who answers the phone? I guess the answer is �it�s better to talk to the person who handles immigration matters�, but as per my observation, immigration person in representative�s office deals with any immigration issues related to constituents.

if a background check reveals that you had been on H-1 you won't be eligible for Z visa. You have to come up with a new face, new name, and new ID. Looks daunting but less daunting than getting GC legally.
I totally agree. They want to issue visas to all of them in a year... They will have more RFEs for legals than illgeal so people should work towards their temporary permnanent residency that is Z

1. "PLEASE Put your real dates in your profile" There is no provision to put dates for CP filers!! All the dates are for 485 filers.
Though it is proven time and again that CP filers are the least needed people on this forum (next to EB3 I - going by this thread), it is unfair not reserving few columns on the profile for CP filers ... It doesn't cost VISA numbers for that...
2. I have told this before but would like to repeat now... I don't contribute because there is nothing for CP filers here. VISA recapturing is the only effort that would benefit CP filers but anyway the chances of that bill passing is close to 0.

I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).
No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.
That's right. I personally know people who have been asked to pay INR 250K (About $6K) to get their H1B done. So the companies have nothing to lose. They just want to have an upper hand with readily available supply of H1B workers if and when an American client is looking for a consultant.
They do this without spending a penny from their pocket and sometimes even make profit just by sponsoring H1Bs for people in India.
As a result, genuine visa seekers are denied a chance to get in and start working right away.

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.

You need to find a new employer and a new sponsor. Sorry its harsh but its the best advice we can give you.
I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? bought AIG insurance..twice, my dad had severe hand pain and could not take him to a doctor, cos, the docs wont accept visitors medical insurance without a cash deposit. then i tried to get pre-certification from AIG, for which they would not give it, so its a catch 22...so screw it, even if ur parents fall sick, all of a sudden when they are in the US, take them to the emergency, there is no system in place for medical insurance for visitors, every other insurance is a scam..so dont even have any hopes..just do what u need to do..there are lots of times, this country does not allow us to live more than 6 years being on h1 without a freakin green card, we have paid lots and lots of taxes which we will never claim..so, this is how they repay.

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.
LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING
