understood the anguish,... But will it do any good. No for sure. If not on H1, If not on L1 then outsourcing companies will find alternative like B1/B2 i have seen many examples... if on B1/B2 no benefits at all get the person get the work done forget the "Person"....

I heard that it needs to be at least 21 months to be able to win the law sue...and suing them might not work anymore when my pending time is qualified.
If someone else with similar names/same birthdays commited a crime, why do we need to suffer as a possibly "HIT"?
If I were to wait for 4 years for Name Check, I rather be the person commiting the crime so they can reject my I485 instantly.

Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.

Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..

However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.
So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!

Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.
For proper handling of cases for retrogressed countries, USCIS/DOS really have no workable method in place.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.
So there, you have your update? If you want to know more, then call us on the phone.
And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.
If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.

If you are one of those members that were once part of IV and either got banned or left because you felt we are working against your interests, then you were never part of this community and effort. This is a genuine effort and a lot of people's careers and personal lives are affected due to the greencard problem and we are genuinely trying to fix it. If you are trying to spread a negative message urging people not to contribute and posting negative remarks, then you either are not affected by retrogression (and so you dont belong here) or you are so naive that you are hurting your own interests by posting negative remarks on other forums.
Lets also see how many members are willing to come forward to actively work for IV and also contrbute for the cause.
lets also see how many H4s come forward to volunteer their time for this effort. We are on H1s and find it hard to manage our jobs and IV work. H4s can be a great asset in our volunteer efforts on various fronts.
lets see if there are any H4s who can commit to meeting each and every lawmaker in their state. Lets also see if there is any H4 in DC area who can commit to spend some hours daily meeting staffers in various DC offices and doing the running around work that some core members do by travelling to DC on their own money and use up their entire vacation time.
If you do any of the above, then come back and tell us what to do and what not to do. Give us all your ideas and suggestions and ask us to execute them for you. Then tell us that we are arrogant etc etc. Then tell us that you can do better than us and lead all of us. We are very open to this.

I think it should have minimal or no impact on your GC process. Somehow you can get gc. But what is the impact of case in your personal life that is more important. If you have an asset or money those are under risk. But if you have very less savings what they are going to achive by sueing you. Also did you have Insurance? Then they might put you and your Insurance company in lawsuit. Then your Insurance company may fight for you. If they win the case and court ask you to pay 1 million dollars then you can file bankruptsy protection and come out if you have very less money. Fighting is always better option than giving up. But again it is individual's decision. As you have option of going to India. But no such option for Americans

The whole movement against retrogression started only when things went beyond reach.
Yes, we believed in a process and planned accordingly but as we get going we suddenly see that the goal post is not visible anymore, it has been removed and moved far putting us all into a limbo state.
It is definitely our right and not a previlige. When we do not see a goal post and don't know where we are heading we do have right to ask "why and what is the solution".
Though we are not citizens we do have the right to seek a fair system.

The story of memorandums is like this. If present law does not have provisions for certain things, then the government departments can publish a memorandum to give some kind of legal basis for their actions. Publishing a memorandum itself is enough to conclude that current law does have provision as such.
Usually these kind of memorandums are made against people who are vulnerable and do not have avenues/options to challenge. There were several memorandums made against undocumented workers not long time back. None of them stand the judicial scrutiny when challenged. Example, there was court ruling in many states that police cannot ask people about their immigration status.
The intentions of this memorandum is clear not to give any more H1Bs to small consulting companies.
I do not understand why some people in the forum have so much anger against the small consulting companies? This is just playing into the hands of anti's . Consulting through multiple layers is perfectly legal and a successful business model. No company wants to hire a person for 6 months project. It's been the goal of anti's to make small consulting companies look bad and they have been successful because of us. If this business model is bad, why not make laws to stop this type of business practice? If you ban that type of business, there will be no need for small firms hiring H1Bs.

EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.
Well what eb3_nepa and me are eluding to has no intention of superseeding the main agenda nor is it in anyway a distraction, it just the germination of an idea out of circumstantial frustration. Also if we truly belive what we are doing is right then there is no question of leaving this forum.
We all support the main agenda and also have a very positive attitude that we will see the light of a bright new day very soon. God willing we all will have our GC in 2 years or so.

That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

As I thought about this further, I figured out the data is even worse than I thought earlier, as this may not have any 2007 numbers. People who filed their labors in 2007 were still waiting in july of 2007. So this data is only upto late 2006. Now the figures could be.
