On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

I think Kerry(i think it is actually Kennedy E who introduced it - SA180 , SA 187 did not have anyhting to do with us it was for Women centers) di dnot have any good intentions for us in troducing this.If you see on Thomas(or congress.gov and search for HR2, see the fourth version, and check out amendments), SA180 was amendment to SA143 (this is by our friend Jeff Sessions). So most probably it was part of politics. Also this status says both these amendments wer eintroduced in Senate but thats it, they did not pass.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . I received my passport exactly in 16 days. I sent $70, they sent only 36 page passport instead of 50. I am going to email for $10 refund!

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Rep.Darell Issa (NY) has introduced a bill to end the Diversity Lottery program and give the 55k visas to EB applicants with advanced US Degrees. This is a pretty exciting development (at least to me).
I think this is a great starting point that we should all jump on to clear EB backlogs.

I and manish flew monday morning sept 17th on a short notice to attend 11:30AM appointment and then again at 3:30 PM with nagaraj.
We had 2 more appointments on 18th with NH senators.
All the meetings were great and one them exceeded 30 minute schedule to 50 minutes.
It was great to meet all the members like aman, jay, paskal, kanika, meenal, nagaraj, pappu, gopal etc.
Paskal: Where is my beer?
Gopal: "Don't shoot the messenger" in the situation room.
jay: Speech pointing fingure to capitol hill behind him. "We are here on offence".
Mike: Step1 to step 5 entertainment
These are some, but not all, of the memorable things in DC.
I really had to mention pappu seperately.
He is a dedicated person to this cause and needs special mention. I really enjoyed his company in the bus on our return journey to NH. We shooted all possible questions and got convincing answers.
Thanks again for the wonderful experience.

Hi,
I sent in my OPT application on 26th of March, and it was delivered there on the 29th of March. I still haven't received a receipt and the check hasn't been cashed yet, even though it has been 4 weeks now.
Today, I just mailed in a letter asking in polite words, WTF happened to the application, and sent it to the Lockbox.. Wonder what's going on..
Couple of questions I have:
1. if I file another application electronically, is there any significant problem other than that I may risk losing twice the fees ?
2. Do I get to send the supporting documents to the black hole lock box? or do I get to send it to a Service center where something actually happens?
Any advice is appreciated as I have a job starting July 5th. And without the receipt notice, I'll be out of status on July 24th.

If your employer comes under the cap exempt category (non-profit, educational institutions) then your H1 will be approved with immediate effect and you can start working as soon as you receive the approval notice. Otherwise, your H1 will be approved with a start date of Oct 1st. In this case, you cant work until that date.

Yes. You can provide new address. I have done this twice and had no issues.

As of now we are gathering people in one place to estimate how many people are there.

I wanted to renew my passport and i went in person to CGI Houston office . CGI Houston will re-issue passport the same day afternoon for additional $150 ( on top of $40 for processing fee ) . I was informed that i can pickup my new passport the next week if i opt for normal processing but I just asked them to mail my passport instead and i received it within 10 days .
