I am EB2-I I-140 Approve, Priority Date of June 2009.
I have completed 6 years on H1 and recently got 3 year extension till Sep 2013. I am working for a small consulting company and the salary is also decent.
However, I have got a great offer, not much salary difference, but the location is in the city where I have lived earlier and I would love to go back. There will be about 50% travel involved though... With my current company I have to move from city to city after 1 year or so... The new job I have is the kind of profile and work which I love.
Do you guys think If I change this job, will I loose my priority date. My new company may not start GC processing right away as I join. They may wait one year before they file the new PERM and I-140. Will I be able to retain my priority date. I am trying to negotiate immediate GC filing but as of now they are saying they have to wait one year.
Guys please suggest what you think.... Is it too risky to change my job at this point.. Will I lose my priority date.

Will your old company retain your approved I-140? OR will they revoke it. There are some confusions in this area as far as retaining the PD is concerned. Some say that if the old company revokes your approved I-140 before your new company files for new I-140 then you loose the priority date. Some say that even if old company revokes your approved I-140 then the USCIS will consider your old priority date unless USCIS themselves cancel the approved I-140 on the basis that there was fraudulent filing by the old company. I will suggest speak to an attorney for clarifications and then decide my friend.

I am in northern VA. I am open to meet on any day. I think it's time we form smaller groups and try to reach our Senators and House representatives at state level.
Nixstor tried to get everyone together but most of us didn't respond to him (Including me). I feel we should fix a time and place to meet, even if three or four of us are able to meet we should not get discouraged at least we can make a start.
I have been a member of IV for last few months though not a very active one, but what I have seen our members doing in last few days is incredible, I have started believing that we have got the strength to pull it through, though we have lost this battle I am sure we are going to win the war.
I call upon all the members from VA to respond back and let us all get together for a better future for ourselves and our family.

Dear IV members,
Has any one used translation service for their Birth Certificates? if so, please suggest me.
I got an (I 485) RFE for translating non-availability of birth certificate issued by Govt. of India. The form (form-10) was in English, but for some reason, the municipality which issued the NABC typed my name in regional language. Now, USCIS wants a translation of the original document.
I have searched on web and got some apparently reliable translators, but wanted to check with experienced IV members.
Any help is appreciated.

Agree: I also strongly suspect that honoring the RD is BS that USCIS is dishing out. I feel they are selecting cases based only on ND and approving them randomly since all their systems, tracking, receipt # seems to be based on ND and not RD. Historically the ND and RD were only a few days away from each other and so it didn't matter - but thats another fight.

hmm, I am not an attorney, but I think all it means is your approval has been informed to the preferred consulate that you chose while filing for extension. I personally don't think you have to go immediately to get it stamped. As long as you have the extension approved with the new I-94 your status is legal in the United states. Only if you leave the country, then of course you will need a visa stamp to come back in which case you have to go to the consulate abroad.

I don't think she can do that legally. I think being on H1b status without work is more of an issue for an Employer.....Employer is bound to pay minimum prevailing wage to H1b worker according to her H1b petition, that may be the reason why they want to cancel her H1. If they do that than she has to transfer to some other status(H4 or EAD).......One more thing, Use of EAD invalidate H status.
What is the issue here with using EAD? An EAD tells that your AOS is in processing, and in the meantime you get privileges of a a GC holder, which means you work (or don't work) with any employer using EAD.

I am in the same boat, my employer discussed with attorney and attorney suggested that I should change employer and try to find a employer who has the direct client, it means there should not be any middle layer of vendors.
Please suggest me if I try to change my employer, is there could be any problem in H1 transferred as my H4 VISA was refused due to my H1 and Delhi consulate has forwarded my case to USCIS with memorandom.
I got the exact same letter as you posted in this form. I am working in desi consulting company in following model Employer->Vendor A--> Vendor B --> End Client.
Please suggest for the same. What should I do in this situation. Also tell me what steps are you taking in this situation. How can we bring out family here ?

My situtation same as yours (without the GC :D). I will be traveling India this December. I have valid H1B (not stamped) and AP expiring on October. Do you recommend me to get H1B stamped in India and not worry about AP (in that way I can save money) and enter as H1B from India. What will happen if my GC gets approved when I am in India? Will I be able to enter with H1B without AP? Thanks.
My 485 was approved while I was in Europe last week. I have a valid AP and H1. Entered US through Newark yesterday - went to the permanent resident queue. Told the officer my situation - showed him H1 and the 485 approval print out from uscis website. He wanted to make me enter on a H1. I then showed him my AP, on which he said I had to go "downstairs". (I have had AP since september last year, had never used it earlier though I have had multiple trips since then. Preferred to use H1).
Went downstairs for secondary inspection. My 485 approval print out was not part of the "package" left on the officers desk by the escort.
When called by the officer, I showed him the print-out. The officer was a nice person - said "you're throwing so much stuff at me. You have a valid AP, a valid visa and now you say you have a GC too?". Anyway - he looked through the system - and said "yes, you are a permanent resident - congratulations !". Tore away the white I-94 form which I had filled just in case, stamped the passport with the date and wrote "LPR" where they usually write "H1B" and that was it. Took about 20 minutes out of which 15 minutes was waiting for the officer.
Hope this helps somebody.

Yet another consideration for EB3 (or rather to EB2 I/C as well) is many people were single when they filed I-485, and now after couple of years they are married, and are able to file for their dependents (thus adding ghost entries all of which are not visible in the pending numbers)

I added another idea in order to curb illegal immigration - Have a 1 year unskilled visa. Punish any employer employing unskilled labor without this visa. Labor dept can decide how many visas they want to dole out per month.

Cheap labor keeps US industry competetive.

1) You can use EAD to work for any company in any profession (yes, you can work on it at McDonalds if things get tough).
2) You need to have a job offer in a similar profession to change your sponsoring employer on the AOS petition - that can only be done after Jan 19. This whole thing is independent of who you work for on your H1 or EAD.
3) Start looking for a new job immediately. If your old employer terminates you and cancels your H1 and I-140, you will have very little time to transfer your H1 to a new employer (withdrawal of I-140 will trigger denial of I-485, which will invalidate your EAD). You will also be without any fallback status if your H1 and AOS are canceled.
4) Your best bet is to transfer H1 to a new employer because H1 is independent of what happens to your AOS case.
Try to leave the employer on good terms (like, if you find a new job and leave to their satisfaction). They will be less likely to look for ways to hurt you. Good luck!

What is the average processing time for EAD renewal at TSC?
I applied via mail rather than online. When I looked at their processing times it is showing 3 months for both EAD as well as AP.
