    AILA just celebrated one of its most successful annual conferences in Las Vegas, Nevada with almost 3,000 attendees. I share a copy of my presidential installation speech where I outline my goals, strategies and initiatives for guiding AILA in the coming year.

    I am grateful to be AILA�s president as we strive for Comprehensive Immigration Reform. AILA remains committed to its mission to promoting justice, advocating fair laws, and advancing the quality of immigration practice. AILA will work hard to make sure Comprehensive Immigration Reform passes to provide a path for hardworking undocumented persons to fully participate in our community, pay taxes, buy homes and eventually become U.S. citizens.     AILA wants to ensure a return to due process protection for immigrants, as well as promote opportunities for bright graduates and essential workers alike.     BERNIE WOLFSDORF AILA PRESIDENT�S INSTALLATION SPEECH, JUNE 4, 2009 LAS VEGAS, NEVADA

    I can�t tell you how honored and humbled I am to be here with you today. My story is the iconic immigrant story � a young man leaves his family, friends, and home behind in search of his dreams for a better life. In fact, thirty years ago this week, I arrived in Boston at the home of my brother and sister-in-law with one suitcase, little money, and big dreams for my new life in America. Like generations of immigrants before me, my soaring hopes and ambitions were tempered by daunting fear and uncertainty, as well as a heavy heart for my beloved parents whom I knew I would never see again.

    While I would miss the home I left behind in South Africa, I harbor no nostalgia for the hatred of apartheid, the noxious race-based political ideology that brought misery to millions there and disdain from the rest of the world. Through hard work and good fortune, I now have a wonderful family, including my wife, Shelly and four amazing children.

    My life�s journey to this point is a culmination of fulfilled aspirations, that I frequently felt were beyond my reach. As clich�d as it is, you are looking at, and listening to the American dream. I am so grateful to this great nation, and to my family, my mentors, our Executive Committee, our Board of Governors, our hardworking AILA volunteers and to the amazingly talented AILA staff. I am grateful to you all, each and every one of you, that strive each and every day to make this organization so special. AILA is unique. We are different � we are a Bar Association that cares deeply about our clients and about our mission and I am grateful to be your next president.

    Having fled a country scorned for its racial ideology, it was true music of the heart when I first heard Presidential Candidate Barack Obama proclaim: �America has nothing to fear from today�s immigrants.� Indeed, for all the hateful rhetoric that too often infuses the immigration debate, our nation need not be afraid of today�s immigrants. They have come here for the same reason that those before them have always come, for the reasons I came: for the hope that is America, for the promise of a better life for themselves and their families.

    President Obama reaffirmed the centrality of fair opportunity for citizen and immigrant alike when he asserted, �America can only prosper when all Americans prosper�brown, black, white, Asian, and Native American.� The Obama administration has declared it will prioritize immigration reform, although the President acknowledged the economic recession will make the political battle over immigration more difficult.

    We in AILA are ready for this coming battle. The need to reform our immigration laws now could not be more immediate or urgent. Never before in almost 30 years of practice have I witnessed such crises in immigration. Immigration raids in our communities and our factories, along with the horrific conditions of detention, have created dread and anxiety within our immigrant population. The process of obtaining lawful status has become unreasonably difficult, and there are few options for the millions of immigrants, many of whom have deep roots here, but entered without visas or have expired visas. Millions of these people have U.S. citizen spouses and children, but no path to legalization.

    Despite decades of living in the U.S., and contributing to our economy, and whether applying for immigrant or nonimmigrant visas, the pattern is the same: restrictive adjudications coupled with outdated visa quotas that choke the system and make the attainment of lawful status virtually impossible. Whether applying through family or employment, the waiting lines are as protracted as they are preposterous. Many with advanced degrees wait for years and family visa waiting lines routinely extend a decade or longer.

    The assault on nonimmigrant visas is equally disquieting. Company transfers, investors, religious workers, professionals and extraordinary ability persons are all subjected to ridiculously restrictive review. The �culture of no� has intensified, and qualified Immigrants who enrich America � in the arts, sciences, education, business or athletics � are being subjected to an increasingly hostile anti-immigrant environment.

    Due process protections that form the basis of our great democracy, have been stripped from immigrants. While leaving office, former Attorney General Mukasey reversed decades of precedent in a shocking decision. With one stroke of the pen, an immigrant�s right to effective assistance of counsel was overturned. A basic right we all take for granted was seized with no appeal.

    For the good of the nation, the system immediately needs to be overhauled. The need is critical; the timing is urgent.

    Just yesterday, Attorney General Eric Holder reversed Matter of Compean and reinstated Matter of Lozada, affirming the right to effective representation in removal proceedings. We have a rare opportunity to redress the dizzying array of problems that beset immigration. We are at a critical junction, and it appears the Obama administration will seize the opportunity to reform our immigration system. When the move to reform immigration laws collapsed last year, the Bush administration and former Homeland Secretary Chertoff embarked on a vicious policy of enforcement with raids and detentions, confining 369,000 persons in 2008 alone. The incarceration of these people continues to take a huge toll. The latest list published by Immigration and Customs Enforcement from February 7, 2009, notes 90 deaths of immigrants in custody since October 7th, 2003.

    What makes this situation even more disturbing is investigative reports have detailed how detainees have been denied access to counsel and appropriate medical care, while some were subjected to excessive force and abuse. For many, the American dream is a dark and twisted nightmare � darker still in the past few years.

    These are the cases that must be subjected to a zero tolerance policy. This year, more than 440,000 people (that�s almost half a million) will be held in immigration civil detention and unfortunately, there is a common misperception surrounding those in immigration custody.

    This government now detains women, children, the elderly, asylum seekers, and victims of torture, longtime lawful permanent residents and, in far too many instances, American citizens � yes, our own citizens! Many detainees are held for months, or even years while they await a final determination of their immigration status. Frequently, individuals are detained without a judicial hearing or access to an attorney. Over two-thirds of the immigrants detained are held in one of the nation�s 312 county and city prisons alongside common criminals. Tragically, more than 84 percent of people in immigration detention are not represented by a lawyer.

    I call upon our President Obama to restore accountability to U.S. Immigration enforcement now! The crises in family and employment immigration are chronic and pressing. The backlog in family waiting lines is gravely dispiriting and undermines the long-held principle of family reunification.

    The daughter of a U.S. citizen must wait 8 years for a green card. If she is married, it is a 9-year wait. If she is from Mexico or the Philippines, it�s 17 years. Permanent resident spouses now have to wait 5 years to live together. It is inhumane and un-American to separate husbands and wives for five years.

    President Obama, I ask you to fix this iniquity now!

    Options for the best and the brightest graduates are also unscrupulously limited. An employer who wishes to hire a Stanford graduate with a masters degree in electrical engineering� who was born in India or China� and for whom the Department of Labor has certified unavailability of U.S. workers� must still wait 10 years to process a green card. At this time, no immigrant visas are available to persons with mere Bachelor�s degrees, whether in science, engineering, technology or mathematics:

    That�s simply astounding � it�s simply bad policy.

    We are stunting economic growth and innovation by making the U.S. a less attractive destination to study, to conduct research, to invest in and to live in, while other nations leap ahead at lightening speeds.

    It has been 20 years since President Bush Senior increased the quota for employment immigrant visas. While scientific advances have occurred at lightning speed in these past two decades, employment visa quotas have been hopelessly encased in amber.

    Does it make sense to educate international students at our top universities and medical centers and then, when at the point where they are ready to contribute to our economy, say it�s time to go home?

    I ask you to help make sure this administration correctly navigates the tensions between business and labor to resolve this nightmare.

    The problem has reached such proportions that Federal Reserve Bank Chairman Ben Bernanke recently stated in testimony to congress: �Our immigration laws discriminate pretty heavily against highly talented scientists and engineers who want to come to this country and be part of our technological establishment.� �By opening doors to more people with top technical skills, America can keep companies here, and you would have more innovation here, and you would have more growth here."

    Bernanke pointed out, �In some U.S. graduate programs, international students simply outnumber Americans. In 2006, more than 58% of graduate students in computer sciences were foreign, and so were more than 68% in electrical engineering. To shun them is to ignore a huge resource.�

    Bernanke is correct. There is no doubt the path to prosperity is paved by the sweat and innovation of industrious immigrants who have fueled America�s growth and success for nearly 400 years. Immigrants have been key to sustaining our nation�s economy in the past, and they are key to resuscitating our economy in the present.

    Immigration reform must be a critical part of any effective economic stimulus program.For immigration reform to work, it must provide a path to legalization for undocumented persons. It must provide opportunity for bright graduates � and it must open doors for those who bring investments, and for those who establish companies providing jobs and making contributions to our nation�s economic growth.

    Are we winning this battle? The answer is �No�!

    But I am supremely confident that if we work tirelessly, if we work intelligently, and if we work together, we can and we will win! Fellow AILA lawyers join me in this mission!

    I am sure you will all agree the situation is deteriorating every day with more detentions, more denials, more delays, more deportations and more defective decisions. Now is the time to turn the tide of the culture of �No� pervading our immigration system. We need to unite families and we need to keep industry vibrant and competitive. Under the current system, fruit rots because there is no one to pick it, and many investors are discouraged. Religious organizations are singled out and subjected to endless investigations. Small companies � often epicenters of innovation � are targeted for denial by repeated repressive restrictive adjudications. These shortsighted policies threaten our economic security and that of our children�s as well.

    As difficult and challenging as these complex issues are, AILA is making a difference! Let me assure you that AILA's professional staff, and our many volunteers are working hard. I am routinely amazed and encouraged by their commitment and diligence.AILA�s mission is clear � we are dedicated to promoting justice, advocating fair laws, and advancing the quality of immigration practice.

    I believe the Obama administration has a clear understanding of the issues I have outlined and I am confident they are committed to fairness and due process. I am hopeful that Congress will heed fed chairman Bernanke�s advice to �trust the free market� and avoid discriminating against highly talented scientists and engineers who want to come to this country and elevate the technology establishment.

    AILA needs to be involved, front and center, to help this administration achieve its goal of reforming our immigration laws. And AILA is involved � in fact AILA is a major participant in the reform immigration for America campaign, which kicked off its national effort to bring about CIR yesterday. AILA has a proud history, and we are in a unique position to partner with other key constituents � including business, religious, student and others to help lead this important reform movement.

    Ultimately, we will be able to muster the support of everyday citizens, too. Polls show that Americans strongly believe -- by a 2-1 margin -- that comprehensive reform is a realistic solution and that enforcement-only policies are not! The country is ready for immigration reform, and AILA must lead the charge � as no one understands immigration law better than we do.

    AILA must be involved to ensure comprehensive immigration reform is enacted, and enacted wisely.

    AILA can win this battle!

    My hope is that we will achieve the highest level of involvement ever from the membership in our proud 63-year history.

    But the time for action is now!

    I ask you will you work with me to make sure comprehensive immigration reform passes?

    Then together we will strive to pass a reform package that provides a path to legal residence for hardworking undocumented persons. Together we will strive to pass a reform package that includes due process protection for immigrants. Together we will strive to pass a reform package that promotes opportunities for bright graduates and for immigrants that want to invest, and for people that want to establish businesses that provide jobs and contribute to our nation's innovation and growth.

    In just a few days, President Obama will host Congressional leaders at the White House, to begin a discussion with policymakers from both sides of the aisle on immigration reform. If you are not already involved, I ask you to join us in what will certainly be the most exciting political, legislative and historic time, for immigration practitioners.

    The time for action is now!

    We have sent out volunteer requests, and I will send them out again and again. Please let us know what topics interest you, and tell us how you want to help. With comprehensive immigration reform on the horizon, and administrative changes in the offing, we plan to create rapid response teams to help with media relations, and with performing Congressional advocacy, drafting regulatory comments, presenting case examples, writing articles, blogging and composing op/eds � and much more.

    Together we can win the battle! The time for action is now!

    We must not allow the next Albert Einstein to languish in detention and ponder the dimensions of his cell when he could be reorienting our understanding of the universe! We must not permit the next Google founder Sergei Brin to spend years in line when he should be here on-line revolutionizing how we access information!

    We must not turn a deaf ear to the next Carlos Santana, so that he can innovate music through a distinctive amalgam of different genres as diverse as our great nation!

    The time to redress this mess is now!

    I guess you are right. It should at least stay the same since there is no new demand reported.

    It is only going to go forward when you calculate the pending cased from May thru December of 2006, it is around 13,600, so it should not retrogress and may move forward? By how much? I am not sure, but it will definitely not retrogress!

    The whole visa bulletin fiasco was only Limited to I-485 and had no impact on I-140s. You could still apply for I-140 in July.

    They corrected their mistake and gave us an additional 17 days to file our I-485. So everyone who was eligible to file I-485 in july can now file upto 8/17 and with the Old fee for I-485.

    That is only true for I-485. If you file your I-140 after 7/29, you'll have to pay the new fee.
    Here are the different scenarios


    1. filed on or before 7/29 : Old fee for both I-485 and I-140
    2. filed between 7/30 and 8/17 : Old fee for I-485 and NEW fee for I-140
    3. filed after 8/17 : New fee for both I-485 and I-140

    I-765 and I-131 fees also follow the regulations for I-485.

    Thank you so much for this clarification:

    1. filed on or before 7/29 : Old fee for both I-485 and I-140

    I thought about temporary license too. As far as I gather those are given only when you are enrolled in a training program (residency/fellowship) and the program itself has to apply for it on your behalf.

    So one might not get a temp license for a regular job (some state boards may have a different rule on this, but by far this is how I find out it is...thro' FSMB)

    After four months of relative quiet, immigration reform advocates are mobilizing a new round of protests in Washington and other cities to put pressure on a returning Congress and reinvigorate a Latino movement that awakened in massive demonstrations this spring.

    The events will begin tomorrow in Chicago, where demonstrators plan to set out on a four-day march to the district offices of House Speaker J. Dennis Hastert (R) in Batavia, Ill., and will continue with one-day rallies throughout next week in Phoenix, Washington and Los Angeles.

    In the Washington region, activists are distributing leaflets, and Spanish-language radio is buzzing about a Sept. 7 rally that organizers hope will be the biggest yet. Organizers say their goal is 1 million protesters from up and down the East Coast for a rally on the Mall and a march to the White House.

    "We want to make sure that Congress and this administration get a very clear message that the immigrant community is still paying attention to what's happening in the immigration debate and that we know that it's election time," said Jaime Contreras, chairman of the National Capital Immigration Coalition, the rally's organizer.

    Local organizers said they are improving on spring rallies that were hastily planned amid a spontaneous groundswell of activism. To avoid a backlash against foreign flags, they are directing all protesters to carry U.S. flags. They are starting the rally at 4 p.m. so student demonstrators, who frustrated school administrators by walking out earlier this year, can participate. And organizers have nearly tripled their budget for portable toilets.

    In media interviews and on fliers, they have simplified their focus to key demands: legalization for the unauthorized and an end to stepped-up arrests of illegal immigrants.

    "We are learning," said Juan Carlos Ruiz, general coordinator of the regional coalition.

    The return to street protest, a tactic that galvanized millions this spring, comes after public discord among activists over a May 1 work boycott and a summer when their focus turned to immigrant voter registration drives. At the same time, new immigration legislation grew even more elusive in Congress, which is deadlocked on the issue.

    Some believe it could be risky. The spring protests roused supporters but also stirred fierce hostility, said Steven A. Camarota of the Center for Immigration Studies, which favors lower levels of immigration. That kind of intensity might make members of Congress, which is approaching midterm elections, even less likely to touch the immigration issue.

    "They want to energize the community . . . to put the issue on the agenda and make it clear that look, it's not going away," Camarota said. "By doing all that, they may also hurt the prospect of the legislation passing."

    The immigrant movement is still developing. Regional coalitions are trying to figure out how to work together nationally, and no clear leader has emerged. Locally, the National Capital Immigration Coalition -- a network of about 60 organizations that has existed for four years -- is just now defining the qualifications for formal membership.

    As for immigrant voter registration, national figures are not yet compiled, said Germonique R. Jones of the Center for Community Change in the District, but anecdotal evidence points to success in some areas. She said Phoenix organizers, for example, are en route to meeting a summer goal of registering 20,000 voters.

    Local results have been tepid. Northern Virginia immigrant organizations had no drives. Groups in the District registered 200 voters, said Kim Propeack, advocacy director for CASA of Maryland. In Maryland, Korean organizations registered 350, while CASA of Maryland registered 425 and quadrupled enrollment in its citizenship workshops, Propeack said.

    But organizers say the movement has not lost steam. Immigrants, they said, are enthusiastic about the coming protests, believing the demonstrations empower them and weaken support for an enforcement-only House proposal.

    "If that's what we accomplished with marches, then let's keep marching," said Jorge Mujica, a rally organizer in Chicago.

    Other observers are uncertain. Carlos Aragon, general manager of Radio Fiesta (1480 AM), a Woodbridge station that has been broadcasting information about the Sept. 7 rally, said the event is a hot topic among listeners -- but they now sound more cautious.

    "Nothing happened in regard to immigration in Congress," Aragon said. "People are just not sure if it will help."

    This week's Chicago march will be followed by protests Sept. 4 in Phoenix and Sept. 9 in Los Angeles.

    Unlike previous rallies that drew people from the Washington region, the Sept. 7 event will include participants from along the East Coast. Organizers said at least 100 busloads of marchers will roll in.

    To encourage local turnout, organizers are intensifying the strategies they used in the spring. They are playing radio promotional spots each hour on some Spanish-language stations. Volunteers are distributing fliers at churches, soccer fields, Metro stations and construction sites.

    With the responsibility of having a demonstration for out-of-towners upon them, local leaders are striving to plan a smoother -- and savvier -- event.

    On a recent night, organizer Edgar Rivera led a planning meeting at the Alexandria offices of Tenants and Workers United. He listed all that will be different about this march: After rallying, demonstrators will proceed to the White House for the first time, he said.

    Organizers will dispatch Spanish-speaking volunteers to Metro stations to direct demonstrators, Rivera told those gathered. And more high-profile speakers will be included -- maybe Jesse L. Jackson and a Catholic cardinal, he said -- but fewer politicians.

    "It's the community that should be out there," Rivera said.

    Hello All,
    I went DDS , GA for renewal of my licence which is going to expiere on 10/26/08. DDS of GA is implementing SAVE programme. Initially they wanted me to come back after five days as they could not get instant verification of my approved EAD. I went after five days and again they asked me come after 30 business days period, as my verfication of EAD is under 3 rd level. Couple of my freinds has the similar problem with the GA DDS. Since my driver liecen is expiring what I should be doing. I am so confused and BTW what is the penalty if drive with expiered licence in GA.

    After lot of research we were shocked to know everyone were charging between 250$ to 450$ .most of them were rude also. I found out one of the USCIS doctor was ready to accept all the tests and shots report from other doctors. We went to kaiser this morning and got our shots, skin test , and gave our blood sample for test. It was covered and we dint have to pay even a single $. However the USCIS doc will be charging $120 per person for physical examination and paper work.

    Take advantage of this if you can, Hope this helps. We are in Sanjose.

    My father had his appointment today. It was a tough day . First he didn't take the blue hdfc receipt and when he got to the line they told him they need the blue receipt and not the pink one. they allowed him to go and get a new one so my father deposited 7k again and got the new receipt
    So after spending close to 15k, he finally went for the interview. the officer asked him only 1 question, what do you do? my father said he has his own buisness and then he asked 2-3 questions related to it. he was looknig at the computer most of the time so i assume he was looking at ds 160. my mother already has 10 yrs multiple entry visa and she came here twice so he asked abt her travel etc
    at the end he said sorry we can't grant you a visa and they rejected the visa.

    Applied for an indian passport extension about 3 weeks ago. When I call to check status no one picks up the phone, when I send email no on replies to it, when I leave voice message no one replies to it or voice mail box is already filled up.
    I am looking for suggestions how to contact them ?

    Boss, no one can help you. Thats the agency's main rule, not to pick up any phone or giving proper response.

    Your only option is just "WAIT".

    If you have tracking number of the return envelop, every morning just check that.

    If you need to travel urgently, then go there in person, you should have a relatively "HIGH" voice and "GUTS" to speak with them to either get it done or get your passport back.

    There are numerous Passport renewals, New Passports, Visas and PIO cards have been discused on all indian consulates and embassy in US.

    Same result. You will not get any response from them.
