Sep 18 is a historic day for all IV members. We all came together for a cause on Sep 18, 2007 in Washington DC. IV has made great progress during the past one year due to active participation from all members.
IV has created greater awareness about the GC retrogression among administration and lawmakers.
We still have a long way to go, but we need to reunite and show the same spirit which brought us together on Sep 18, 2007 in Washington, DC. If we could regain the same spirit and enthusiasm, and work together then retrogression will be a thing of the past.
The rally showcased the GC retrogression as an issue and lawmakers are beginning to understand our problems. IV has made great progress with administrative fixes and now many are enjoying the benefits of 2-yr EAD.
IV has made progress to get legislative fix through various bills and now HR 5882 is almost knocking on the House door.
Let us rally our members to keep the focus on abolishing the "GC retrogression". This the greatest thing we can do on our first rally anniversary
Thanks IV core and all active members for the great effort.

Let me put it this way,
I am in a better position if I quit 1 day after GC approval to move to a job in my line of work than if I quit 1 year later and move to a different line like starting a grocery store or restaurant. If changing jobs is an issue at naturalization (we have no evidence of that), then the former case has better credibility than the latter - though I waited longer.

is your bachelor's degree a 3 year degree? if that is the case, they sometimes do not consider an M.Sc as a master's degree. Also, which university is this? Does it have accreditation? Nowadays there are a lot of universities like United Nations University in Delhi which are fake

can the employer withdraw i_140 once it is approved?
thanks
The employer can withdraw I-140 at any time, but after 180 days of pending I-485 it won't affect your I-485 application (provided you have another job or job offer).

I have two kids, my son is 8 years and daughter is 5 years old. Since it clearly says in 485 form that FP is not required for kids below 14, we didn't pay for FP fee of kids and attorney confirmed it then. We got FP notices for me and my wife on Aug 1st and we completed it. Later on after a week we received FP notices for my son and daughter for Aug 23rd even though we didn't send the FP $ for them. We just went and completed the FP for kids on Aug 23rd :)
I know one of my friend who sent FP money for his kids along with 485 application even though they were below 14 and he did get FP notice for them and they all got GC approved now. He was a March filer.

I had the same question. According to discussion with my lawyer, the option to stay on H1 is a personal one. In any case you are using AC21 whether you get a new H1 for another co. or use your EAD. The advantage of being on H1 is you are still in status and working even if your 485 petition is turned down and you can apply to extend H1 (of course depending on your situation, labor filed or not, how much time left etc. etc.). But if you are on EAD you might yourself in a jam if your EAD renewal is turned down or delayed. You could be out of status. Also, if you want to go back to H1 from EAD you are back in the H1 queue (65k or 20k masters). You cannot transfer to H1 from a EAD job anymore without an approval thru a brand new filing.
If your I-485 is turned down then you will not be able to get extensions. Reason is H1 extension past 6 years are based on pending GC. If 485 is turned down then there is not pending GC. In my case my I-140 will be revoked within 60 days so I will need to transfer H1 before that. After it is revoked I will need to restart my labor via new company and have that pending for over a year to be able to get further extensions. Otherwise I will need to use EAD after H1 expires.

Job title need not be the same. Its the job duties which have to be same/similar.
Hi roseball,
Thanks for your quic answer.
While porting from EB3 to EB2, EB2 job duties should be same/ similar as EB3 job ? or EB2 job duties should be little bit more that that of EB3 ?
Thanks,
BKY

Sorry to interupt your thread, I am in H1b now and I did not renew my EAD last year since it was expensive for me if i have to got thru lawyer.
My i140 has been approved and my i485 wad filled July 2007.
I am still working right now and I just want to be safe for worst case scenario. Do i need to have EAD to continue employment if i get a lay off (lay off means they stopped the H1b not the i140)
is having EAD very important for H1b visa holder (with i140 approved and after 180 days of 485 filing) for worst case scenario?
Thank you,

Going by your logic, this is our "Future Anthem" and not the current.
GC and Citizenship are two different things and let's keep them separate lest we will end up confusing issues.
As many of us have not thought or made up our minds about citizenship, this only comes across as a form of appeasement, unless we are singing all the national anthems one after the other.
Choosing to sing or not to sing the Anthem is everyone's right. Even some Americans refuse to recite the Pledge of Alleigance. Yet, at IV we call ourselves what we are "Future Americans" and therefore this is our Anthem. Just like many of us are from India, China or elsewhere most Americans also have foreign ancestors and feel a closeness to those countries on some level. Yet, the idea here is to show respect for our new country, the country that we have adopted, and which has adopted us.
Americans appreciate people who come to America for true love of the country and wanting to assimilate and contribute to its greatness. Look at what the illegals did in their rallies carrying Mexican flags and translating the Anthem into Spanish, rightfully angering American citzens. This is our opportunity to understcore how totally different we are from illegals and how we have earned and deserve our green cards.
For those of you who are not ready to sing the Anthem as your own country's anthem, then perhaps you can sing it just as a show of respect for the country that has welcomed you. What do you guys think?

Yes employer can revoke 140 at any time.
If the employer revokes 140 after the approval , it doesnt matter and while approving 485 USCIS will ask for an employment verification letter.
If the employer revokes before I-140 then I think with the new employer u need to start the whole process and u have to use h1 transfer
My suggestion is hang with the employer for another 6months and meanwhile ur I-140 will get approved. Then u are on the safe boat.

I really believe that USCIS will make the dates current again because the people stuck in the BECs did not get a chance to file in June-July.
IMHO the BEC victims should sue DOL citing unfair treatment. That will turn the wheels and make the dates current again.
Some people called you an idiot. Its easy to make such a remark. I wonder what those guys would have done in your shoes. Specially since your employer did not live up to a promise. Do name your employer we can blog against them.
All the best!

I hope I do not have to explain the relevance of the following to computers.....
"0 (zero) is both a number and the numerical digit used to represent that number in numerals. It plays a central role in mathematics as the additive identity of the integers, real numbers, and many other algebraic structures. As a digit, zero is used as a placeholder in place value systems. In the English language, zero may also be called oh, null, nil or naught."
"The concept of zero as a number and not merely a symbol for separation is attributed to India where by the 9th century CE practical calculations were carried out using zero, which was treated like any other number, even in case of division.[7][8] The Indian scholar Pingala (circa 5th-2nd century BC) used binary numbers in the form of short and long syllables (the latter equal in length to two short syllables), making it similar to Morse code.[9][10] He and his contemporary Indian scholars used the Sanskrit word śūnya to refer to zero or void."

Questions remained unanswered...
I have tried to get answers in other threads and failed. Would try here :)
I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR.
My question is : How these two immigrations can jeopardise each other?
Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview...
Does the fact that I have a Can. PR will kill my future GC and at the interview they will deny and cancell my case?
Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR?
I should mention that the GC is the choise No1 , and PR is a plan "B"...
I believe that my situation is not unique, but now I am out side the US and in my country it is almost impossible to find a competent immigration lawer. So I hope that somebody from this forum could answer my questions.
Appreciate all useful answers and ancillary information.
Please,share your opinions!:)

Phoenix has smaller number, but still a lot, I could feel that when I went for medical.
If required, then lets do a peaceful march in Downtown PHOENIX or TEMPE or CHANDLER. These are the cities where a lot of immigrants live.
I think the number of people should be atleast 50(too less??) to have it as a march.
I will study how SJ rally was conducted and how to get media coverage.
Any inputs and leadership welcome.
I am from Phoenix, and I can bring in at least 10 to 15 people.

After careful reading...It is not CIR...just for H1s
Two United States senators have proposed a bill that will give US workers first crack at technology job openings and toughen the H-1B visa program, reports said.
The Senators announced the filing of their bill on the same day that the US Citizenship and Immigration Services agency began accepting H-1B applications for the federal government's 2008 fiscal year.
The bill -- introduced by Senators Chuck Grassley (R-Iowa) and Dick Durbin (D-Ill.) just before Congress departed for its spring recess -- is designed to curb abuse of the controversial worker visa system, CNET News.com reported.
