Thanks for the quick response...
What are the downpayment requirements on a short sale or a foreclosure property?
Is a bigger downpayment required to buy a foreclosure or a short sale property?
The downpayment required for buying a house depends on the loan that you apply for and get approved. It can be anywhere from 3.5 % to as high as downpayment you want to make. If your downpayment is less than 22%, then you have to pay mortgage insurance per month. If its a regular traditional loan with less than 22% down, you have to pay PMI (private mortage insurance). If its an FHA loan (Federal housing authority), then you have to pay MI (Mortage insurance). FHA means that you are buying mortgage insurance from Federal govt. and the rate would be slightly lower. Also, with FHA, the minimum downpayment is 3.5%.
For making an offer on the house, whether its for sale under normal circumstances or under distress (foreclosure, short-sale), you have to put money in escrow (also known as earnest money). That money is kind of deposit that you put down so that if you suddenly change your mind at last minute, then they can take that money away from you. It basically ensures the sellers that you are serious about buying the house and its worth going thru trouble of selling process and the closing process. The Earnest money is escrow is variable. It could be as low as 2000 dollars or as high as 3% of the value of house. Depends on the seller. If the seller is stubborn or worried, they may ask for high earnest money. IN case of short-sale, the bank may ask for higher amount of earnest money so that they get offers only from serious buyers and not just trolls.

Did you talk to him of the scenario if you don't use the new SSN for a job?

I probably can find all my answrs if I search, but I am unable to perform the search (the security image with numbers is not visible in my computer, so I am unable to search anything). Please forgive me if I am asking for previously familiar information.
I have H1-B renewal approved until 2010, but I do not have a renewed H1-B stamp on my passport (same for my she does not have renewed H-4 stamp on her passport)
We have currently applied for I-485, EAD and AP. The checks were encashed just recently,
My questions are regarding H1-B validity,
1. Is H1-B still valid, if I travel outside US and re-enter using AP?
2. Can I get my H1-B stamped at a consulate outside US and re-enter US on H1-B without using AP?
3. Is H1-B still valid, if my wife uses her EAD to find employment?
4. If I find secondary emplyment using EAD while I still continue to work for my primary employer - is my H1-B still valid?
Please reply to me if you can help me with the above questions.
Best Wishes!

Answer is obvious. Tell your "friend of friend" ;) never to lie on immigration forms.
I don't get his case any way. How is going to cliam back pay if he never worked for this employer?
Folks , don't flame me because this is a friend of friend info. This person came into USA in around Dec2009, without informing the petitioning employer. He found a job in last few days and approached the employer. His employer is asking him to leave the country and saying he would revoke h1.
This guy wants to report to DOL and get back pay but he will have to misrepresent some information to make his case. If he tells DOL that I came and never informed the employer I am doubting DOL will side with employer. I was advising my friend that a bigger concern is if he lies to make his case and that lie is found out he may be in bigger trouble for lying on official form and supplying false info to a govt official.A am advising that the best would be to either get the matter resolved by negotiation and if the employer doesn't budge, leave the country.
Can some one comment if my doubts are unjustified?
Part II: Will this friend be in trouble ,if he helps the guy with lying and the follow-up process.
Please share your opinion.
Please note: I 100% support reporting violating employers to DOL.

Once you get Canadian citizenship you can always get into US on a T-1 visa...
TN is no solution for permanent jobs as you have to renew the TN every year. You run the risk of being denied entry each time you enter. I have seen most people apply for a GC anyways for that reason, particularly if a family is involved.

Munnabai,
There are 2 things you are clubbing here.
Issue 1:
======
Regarding changing employers after I140 Stage, This is what i have understood from reading various posts.
a) You have lost the LABOR, I140 of the previous employer. The employer
can substitue the same to some body else. This is where the controversy and issues and new rules are coming into picture. To limit this for 45 days.
b) You have to Start the GC process all over. i.e NEW LABOR, NEW I140
c) While applying for NEW I140 you can ask USCIS to port your OLD PD by sending the Previous I140 Copy. Again the experience on this not consistent.
d) The PD Is yours even if the employer is revoked it. But this is again Tricky and the rules are not clear. Some people got it done some don't.
Issue 2:
=====
Who will get communication after I140 stage. This is relavent if you just change the LAWYER or APARTMENT.

By the way here is some info: may be helpful for some.
My officemate applied for 765/131/485 etc on 6/26/2007 to Nebraska.
He checked his online bank stmt.
His checks got cleared today 9/6/2007.
Check had SRC numbers on them
USCIS case status site, for that case said "your case is in texas!"
He is happy.
That gives me a hint that my case may move to Texas too, who knows and that if my submission was done on 7/19 I should expect my checks to get cashed by 9/30/2007 MAX....
Lets see how it goes.....

I think this is a really bad idea. Green Card is fine.. but remember, we are first Indian, Chinese.. we are citizens of our countries..and owe allegiance to it....atleast till the time you get your american citizenship.

I think DOL should implement the 45 day rule ONLY WHEN LC IS SUBSTITUTED, and If the LC is used by the same person on whom the COmpnay Apllied LAbor, then This RULE SHOULD NOT BE APPLIED, that way the Original Candidates are protected... Any thoughts???

Dear IV members, I would like to share my GC story with u. I have been in the US since 2001 mostly on and off. I wasnt sure whether I want to permanently live in America and thats why I havent even thought about getting a green card before. Last year I made up my mind and applied for an employment based GC. I started my labor on January 1, 2008 (first ad in the local newspaper) and labor was applied in Fabruary. BTW I am EB2 (rest of the world). My Labor was approved in the end of April. Conccurently filed I-140 and I-485 along with AP and EAD in mid May at TSC (RD May 14 and May 20 respectively, FP done June 28 and no LUDs whatsoever after that, was a little upset over that). My birthday was on Aug 19 and what a huge present I had. I still cannot believe my luck. First on Aug 18 EAD approval followed by my I 140 approval on Aug 22 and 2 hours later I received the magic email: I-485 current status: Card production ordered!!!!!!! Unbelievable! I couldnt believe my eyes. I logged in a logged out of the USCIS website 3 times to make sure that it is not a mistake. 3 days before the approval notices I was talking to my parents telling them that I will probably wait for another 1-2 years and then I got it! No RFE no questions whatsoever. After I saw the email I felt such a relief and sense of freedom. Later in the day I spoke with my lawyer and he couldnt believe that the 485 was approved. To be honest with u I didnt even know the whole process of getting a green card (lawyer was taking care of it) before I stumbled on the Immigration Voice website after a google search. I have followed all of the threads for the last 7-8 months here and I find them extremely helpful and a great source of information. Sorry for the long post and I wish you all to get your green cards from the bottom of my heart. My 8 months are nothing compared to some of you who have been waiting for years so my advice is to spend a lot of money on a good lawyer and hope for the best, the rest of it is in God's hands. Thank you for reading my post and God Bless America!
Enjoy the new found freedom...

How Red Dots are given?
On your post, right next to the posting date, there is the post #. Right next to it there is a icon (similar to the one used for justice)....when you put the mouse it says "Add to XXXX's reputation" where XXX is the poster's user name.
Here is a green from me! yes, EB sucks, big time!

Congrats Mark. Must be a big relief.
You have done much for the high skilled immigrants and been a wonderful ambassador for IV. I hope you will continue your association with IV.
You ma not have thought about it, but few years from now folks here may be campaigning to resolve citizenship backlogs. Let's keep this good thing going!!
Cheers!!
thanks,
I'm still calling law makers, still making contributions, still harassing my Congressman , and still spokesperson.
What I'm not doing is checking visa bulletin, processing times, and trackers.
