� Exempt foreign students who earn masters degrees or above in the United States from the H-1B visa numerical limit.
� Exempt STEM advanced degree graduates who have 3 years of U.S. work experience as a non-immigrant from the numerical limit on employment-based immigrant visas, in addition to those who are deemed to have extraordinary ability, are outstanding professors and researchers, and whose presence is determined to be in the national interest of the United States.
� Exempt spouses and minor children of the principal applicant from employment-based immigrant visa quotas.
� Exempt foreign physicians from the immigrant visa quota if they agree to work full time for five years in an area with a shortage of health care professionals, or if they work for five years in a Department of Veterans Affairs health care facility.
This seems to be a very nice bill with limited and non-contraversial provisions unlike SKIL bill. SKIL has somany provisions that makes it hard to convince the law makers. But this bill is very nicely drawn by getting impartant ones that we all need.

Hi Group,
Thanks everyone who have taken time to analyse and respond to my questions.
My spouse is also from India and can not use DV scheme.
I hav some simple questions:
a) Can I transfer my H1 to some other co freely ?
b) Do I need to restart my Labor and I-140 OR wait and file I-485.
c) If i can file I-485, then what documents i should possess.

Thats why visa bulletin threads are of no use. We will continue to see this trend unless a bill passes. Hope more people take part in IV activities now and contrbute to IV.

Gurus,
I am having trouble with my employer and the situation could lead to my layoff very soon.
I filed my I485 this July 19, and hence, still have some time before I can use AC21. My I140 is approved and I just received a mail yesterday that mine & spouse's EAD cards are approved and I expect to receive them soon. I have about a months vacation hours accumulated and I wish to use these to search for a new job.
I would appreciate if someone can answer the following questions:
1) Can I use EAD to join some other company at this stage? If yes, I believe the job title & salary has to be in similar conditions.
2) If I leave my present company, would the employer know that they need to withdraw I140 (My management is quite dumb when it comes to these matters but they know that they need to inform USCIS when H1B person is terminated)
Please suggest the best course of action for me. Your help is truly appreciated!
If I were in your shoe, I will explore options where I can go on unpaid leave of absence. For example, some companies allow to take unpaid leave of absence to take certain courses, or to take unpaid leave of absence to go and take care of elder parents, or any sick member of your family. Some of these laws are mandatory to follow. For example in state of NJ by law, you can get upto 12 weeks unpaid leave of absence to support your family members. Just try to find one of those clauses and see if you can invoke one of those. You are just buying time here and the end of such period you can go back and resign from the company. This will maintain you employee status with your employer.
Falling back on H1 may not be a good option for you because you will have restart you GC process.

There is a concept called Nunc pro tunc to correct situations like this with retrospective effect. You should discuss this with your lawyer. Search Murthy.com who has claimed success for some H4 cases who "forgot" to extend their status along with their spouses. So it is doable with a good lawyer.

What if one does not have an SSN?...my wife is on H-4 and does not have a SSN...she has a ITIN.....
Form does not have ITIN column. And you can not write ITIN in field meant for SSN.

if you get their caller id# (as some one mentioned 408) you can block them from calling you. You can add this number online using vonage or sunrocket protal (for most voip homephones atleast) - something called blocked numbers. I haven't tried this with vonage, but did it with sunrocket.

is this related to inspection or something else? why seller doesn't do it and sell it, because it is expensive and time consuming procedure?
CCO is certificate of occupancy. Its a certificate that you may be required to get from the town or city (Municipality). This certificate would state that the property is up the to code (building code) of that city and there is no work done on the property without permit. If the house, for example, has broken plumbing, septic, or if it has bad paint, or unfinished exterior paint and looks bad from outside for the neighbourhood, then the town or city (municipality) may ask you to fix it before they issue you a CCO.
Sometimes, and most of the time in foreclosed properties that are bank-owned, the owner would have left the home already and it would be a vacant house. Some disgruntled owners would leave home even damaged. So there is no owner out there to get CCO for you. The banks are not really equipped to handle such things. So they ask prospective home buyers to do that legwork of getting CCO. If the house has nothing broken or illegal (like construction without permit, additional floor or room without permit) then CCO should be easy.
About smoke cert, I dont know. There is such a thing called Radon inspection - Its a part of home-owner inspection these days. Radon is a gas emitted from some polluted lands. Its rare but they check houses these days for that too since last few years. Your home inspector would take care of the Radon inspection as a part of overall inspection. I think that's what the smoke test means. He may also advise you on whether the House would easily get CCO or not.
The other reason why the BUYER should pay for inspection is that you want the inspector to be loyal and answerable to you. If you are paying the inspector, he will be faithful to you and tell you if there is something wrong in the house. If the seller gets it inspected, then the inspector has no incentive to look after your best interest and may not report on the hidden faults or defects in the house. That's why its a good idea to find your own home inspector and get it inspected.

Few people are here with pre-drawn notions and believe in red and green dot game. It is only free for those who filed I-485 with the new fee of $1010. AS for you, you will have to pay the renewal fee each time you renew your EAD and/or AP until your 485 is approved.

My wife took her CPA exam in 2002 May in California. She is on H4. So do state to state have different rules or did it get changed now.
Why a SSN is required to do CPA. Even in India CPA courses are conducted and people come here in visitor visa to take the exams. Check with Becker conviser. http://www.beckercpa.com/. My wife started with this institute in India with her CPA before our marriage itself and took the exams after our marriage.

If you wanna hear something REALLY stupid here goes. My wife wants to do her CPA in PA since we are living in PA. But guess what she CANT. Why you ask? Coz to even DO a CPA you need to have a SSN. Yup u guessed it, cant have an SSN if you are on an H4. So now she has to do it in DE becoz of that.

I am starting this thread to discuss why/why not USA need Illegal immigrants more than Legal immigtants. I want to see why one group should be favored over the other group from an American prespective.
Some of my observations:
Illegals are seen as
Law breakers, Will do the dirty work that americans will not do, will work for less than minimum wage, exploited, harassed, 12 million in number and so need support.
Legals are seen as
Take away american jobs, make more money than illegals, will bring down white collar wages down and so on and do not need support.
The above sentiments may drive what is happening in the Congress.
Your Comments? Observations?

3 times the minimum wage for a skilled -worker is not unreasonable at all in the US. It comes to roughly 47K. How reasonable this factor of three in Europe I don't know. 60 (??) days of paid vacation, great culture and food (experience limited to Spain, Italy and Switzerland) sounds great actually. If only Blue card were a reality. On the other hand I love this country and the opportunities I got here to pursue my dream.

Yes, why is USCIS still accepting EB3 applications when they will get GC in the next 40 years ?! This is absolutely ridiculous !
I know people are waiting for GC from more than 10 years in EB3.... at the same time I know someone who got GC with in a year under EB2....why is it like this??
I know EB2 are more qualified skilled labor than EB3...
And also I know any of my posts will not change the process.
