I collected my passport with the visa stamped yesterday from the VFS center in chennai. I sent an e-mail on tuesday to the consulate and i got a response from them saying it could take another 4 days approx and the delay was caused by the recent change and the introduction of the PIMS database. It looks like they are digging through your old records as well.
For those people whose passports have been delayed, it's most probably due to the PIMS database and i suggest strongly to send an e-mail with the subject line "PASSPORT PENDING for more than 5 days" and you would most often get the response the next day. Do not call the consulate as they don't tell you what you want to hear. The person who answers the call is an indian and he/she would not have much information to give you.
Could you please let me know when was your visa appointment and how many days it took before you got your passport. Mine was 6th Dec and no update from consulate yet.

I also got email from CRIS last night stating that my I-129 has been reopened.
I have a very simple immigration history:
I-129 filed and approved April 2005, petition expires 3/30/2008; only ever worked for this same company.
No H-1B extensions ever filed, no H-1B transfers ever done, no previous history of US immigration prior to April 2005.
Labor, I-140 and I-485 were filed November 2006; I-140 approved February 2007, I-485 approved June 2007, EB2 green card arrived June 2007.
There was a LUD on the I-140, in August, but that was about the same time as a bunch of other people got LUDs on cases starting SRC07... seems like I can disregard that.
There was also a LUD on the I-129 without a status change later in August. No explanation for that was apparent.
And now I get a notice on 10/23/2007 saying that the I-129 has been re-opened and that something will happen within the next 30 days. I'll be sure to keep you all updated if I get anything like an actual I-797 notice through the mail.

You are purely thinking about your perspective and neglecting the purpose of GC for the country.
To qualify in EB1/Eb2/EB3 depends on some factors:
EB1: Extra ordinary candidate, may or may not be represented by employer
EB2: Senior Level: Job duties have to justify need for advance degree candidate (or BS + 5yrs exp) and then candidate must qualify too
EB3: 16 years of education (ideally) with degree in related field (lets talk IT for now)
Now current status and its cause:
EB1: - No jumping, no gaming system : Hence NO DELAYS
EB2: - Good chunk with genuine apps, some gaming system where applicant qualify but not the job, some gaming system and taking very high risk by showing BS +5 yrs (they actually don't have +5 factor), other jumping the category (legally :D) but taking very high risk for RFE
Result: Got retrogressed
EB3: Good chunk with genuine apps, some unfortunate ppl who do qualify but job doesn't support experience or higher pay, lot of gaming system with BS (3yr) in non Computer/IT and showing 1yr certifications etc, and everybody who does not qualify for EB1/EB2, lot of nurses (I heard someone said nurses in back)
Result: Severely retrogressed with no hopes in horizon
Now lets look at market demand ( we know supply of apps is pretty darn good)
EB 1: Very very high : general pay range starts from $250k+ and goes up to $400k for fresher (PHDs) and in upper $150k for Int'l Managers
EB 2:: High, general pay starts high $80k and goes somewhere $140k+,
EB 3:: good, starts from upper $40k and goes somewhere $65-70k, (lots of job and lots of applicant)
Now lets take a look at Supply of Apps (Assumption 1M apps already in system):

Sent in my contribution, even though i havent started my green card process yet .. and may never get around to starting it if the GC status quo continues. However, this is a just and commendable cause, and I believe we should do all we can to get favorable reforms passed now .. strike when the immigration iron is hot.

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

Sorry to hear about your case. Trust me, such liability suits are extremely common these days in America, and there is no cause for alarm as long as you take all the necessary steps.
If you had liability insurance for your auto at the time of the accident, the first thing you have to do is to call that insurance company and let them know about the lawsuit. THEY will hire and pay for a lawyer to defend you. If you want to be even more comfortable, you might also hire another defense attorney by yourself.
The catch is, your insurance lawyer will only defend you upto the amount of liability mentioned in your insurance. If there is any judgement over that amount, your personal assets are at stake. This happens only in very very rare scenarios. Most of the times, such lawsuits are settled out-of-court. The amount mentioned in the lawsuit ($3.25 M) is totally irrelevant- what they would eventually get (if any), will be far far away from this figure.
Assuming that there are no criminal charges, and this is a civil tort case, there will be no impact on your immigration proceedings at all.
Make sure you take all the paperwork very seriously and do not ignore any letter/notice/deadlines. Don't even think of running away- its not worth losing your career you have worked so hard for. Unless yours is an extremely unusual case, all that you stand to lose is several nights of sleep and thats all.

I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:
1. All US degree holders will be benefited.
2. These US degree holder Numbers can be used by Non-US degree holders.
As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. You may want to visit your congressmen/congresswomen and try to help from him/her.This might take a while without doing anything. My background check has been pending since dec 2009, I have not done anything yet because my PD is not current. I will be requesting their help next month or as soon as my PD is current. IV has helped some folks who were stuck for long time. May be you can request their assistance. This is BC process could be pain ....

Picture will become more clear in MAY when Pres. OBAMA will announce his plan for CIR 2009. If he does then chances of this bill going anywhere is very minimal. Also don't forget that this is just in senate. Same version needs to be pass in House. Amendment to Stimulas package regarding Financial Company cannot hire h1b was relatively easy. It doesnot need bill go through all sub committee and other lengthy process.
I think we should focus only on our main agenda. Green Card. We can closly watch this bill. Even if it advance to subcommitte in Senate ( Hearing and all ) then we can start move on it otherwise we will waste so much of our manpower and energy.
Wouldn't it be their statergy to divert / divide people on H1b / L1b issue so we loose our energy by the time CIR 2009 planing going on. And they can easily add some more real actions in CIR ?

Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

Thank you. I am trying to find out if people have got denials in spite of going through the NOID process.
Received one today.
Weirdest thing:
Person's 140 was revoked by employer;
person received notice of intent to deny. NOID clearly stated that 140 was revoked by employer then quoted ac21 law and said beneficiary may be eligible and to give job offer letter.
person responded with letter from new ac21 employer with perfectly matching job duties/descriptions.
uscis sent denial. Denial only stated that 140 was revoked and 140 immigrant petition is needed to get greencard.
Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.
Received one today.

I don't like idea of making IV a commercial-type business. IV is for legal immigrants and it should be funded by Legal Immigrants, however, practically its not that easy as it sounds, and more importantly its not working enough for IV to operate and generate results that we are waiting for.
Problem is not that we don�t have money as small as $20, issue is we don�t want to pay. The reasons could be a)- we don�t understand importance of IV, b)- don�t trust IV fund management, c)- love freebies, d)- don�t have money e)- everything else.
Lets talk about e)- there are 31000 reasons not to donate to IV. Well no matter how hard we push there will be people who will never contribute. I met quite a few who been saying �yeah� for quite sometime and visit IV almost daily but have not contributed $0.01. Can�t help them who can�t help themselves.
d)- don�t have money: smells fishy, we are Hi-Tech workers, get paid really good and can�t donate $20, I don�t buy this idea. Better explain me next time.
c)- love freebies: its great concept, I like it too, but when IV is fighting for us, the whole legal immigrant community, can�t we donate $20 for our own future. Lets take it as a lottery, we buy ticket, we may win and may not win, compare it to IV, we donate to IV, IV may be able to resolve issue before we even reach there in GC process (just like name check), and IV may not help retrogration, but still we come to forum, get information about process, discuss our own case, get seniors/gurus review of our own GC case/issues. We can�t go wrong with that. Its doable, just $20 for all this.

Trust me this Delta is getting bigger and bigger for you. Donating to IV may not seem important right now, think again you are going to invest in your future. Problem is not that we don�t have money as small as $20, issue is we don�t want to pay. The reasons could be a)- we don�t understand importance of IV, b)- don�t trust IV fund management, c)- love freebies, d)- don�t have money e)- everything else.
Lets talk about e)- there are 31000 reasons not to donate to IV. Well no matter how hard we push there will be people who will never contribute. I met quite a few who been saying �yeah� for quite sometime and visit IV almost daily but have not contributed $0.01. Can�t help them who can�t help themselves.
d)- don�t have money: smells fishy, we are Hi-Tech workers, get paid really good and can�t donate $20, I don�t buy this idea. Better explain me next time.
c)- love freebies: its great concept, I like it too, but when IV is fighting for us, the whole legal immigrant community, can�t we donate $20 for our own future. Lets take it as a lottery, we buy ticket, we may win and may not win, compare it to IV, we donate to IV, IV may be able to resolve issue before we even reach there in GC process (just like name check), and IV may not help retrogration, but still we come to forum, get information about process, discuss our own case, get seniors/gurus review of our own GC case/issues. We can�t go wrong with that. Its doable, just $20 for all this.

Please don't flood/SPAM Senator Grassley with your E-mails..
If there is any such program to contact any senator, it will be announced by IV core through State chapters network. That's the purpose State Chapters were created! Right now no such action plans exist!
A sincere request to anyone, DO NOT create your own 'Action Items' on Legislative actions. Reason being, legislative matters are delicate and need careful handling. If handled without a holistic perspective and professional advice - which only IV core can provide - may backfire and harm IV cause, instead of helping it!
Regarding H1B
If the system is broken, it should be the responsibility of DoL and government to fix it. Laws on book should be enforced first before introducing new laws. Raising the fees to astronomical levels will kill the program instead of reforming it. Real fix to H1B issues is increasing the number of green cards and provide a level playing field. Wish there was work on permanent fixes to the system instead of efforts to kill it.

My PD is Nov 2004 (EB3 India). My 140 has not been approved yet. Also, I do not plan to use EAD so issues thereby are out of question. My only worry is can I keep renewing H1B while my 485 has not been approved. My attorney says NO. He says that you can apply for H1B extensions after 6 years only if you have not been able to apply for 485.
However based on your responses, it looks like I will have to validate this with some other lawyer to make sure if I can keep extending my H1B so I can maintain my wife's H4 status.
From what I know your lawyer is wrong, you will get one year H1 extensions in your case.
