(1) EAD -To have the remaining of H1 as back up: If I use EAD and move to the new employer and also send AC21 documents to USCIS. My current employer will cancel H1 and revoke approved I-140. Also looking at the current scenario if USCIS denies 485 within a couple of months how do I get back to H1-B ASAP while I file MTR?
(2) H1 - Maintain H1 and use AC21 with H1 transfer(I will have around 9-10 months of H1 remaining at this point of time): And if current employer cancels H1 and revokes I-140 and that triggers 485 denial, I will still have some H1 period remaining and this should aid me in CONTINUING the new JOB while I file MTR?

I got a Soft LUD too on March 25th,2009. Probably routine scanning of applications to check if all documents are there or not. My receipt date is July18th,2007 btw.

3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
Last thing you want to do now is to lose hope. You have gone through a lot of stress, but you've got to fight this out!

i called a couple of times spoke to Inf officer at NSC ,
&& she told she was not aware of cases where NSC has created rejection letters and sent them also she added they just completed june filers and will be starting to proceed with JULY .
Now reg. my processing times:

Receipt Jul 2 9:54 : FedEx
status : On Hold ?
Checks : Not cashed Yet
She also adviced most probably i should receive some kind of communication before end of july !!

It is really frustrating that some people instead of volunturing for effort tries to find loop hole or excueses in the IV's efforts. If you can not volunteer atleast support those who are doing that with lots of energy and determination for our cause.
Utlimately at a one day WILL WILL FIND A WAY.
If we are willing to help ourselves than only this thing will happen.
So keep faith in IV core and its efforts and be supportive to their efforts whenever you can.
IV CORE- Please ignore messages from some of the members and KEEP your ENERGY and EFFORTS towards our ULTIMATE GOAL AND MISSION. You all are doing an excellent work.

BTW: Does any one know how long does it take for a decision to be made on an application once it has been pre-adjudicated and assiged to an IO?:confused:

Sure if your ideas are good and conceivable Core team would defly work on implementing it. Dont be an outsider, try to get more involved. Again if you want to be part of the Core Let Aman & Co know, they should be able to delegate you some responsibilites.
Just like you, everybody is frustrated with the lack of progress. But we do understand our limitations, we can only educate the lawmakers with our issues, but we cant arm twist them to do something favorable. We have to keep our expectations right. As Logiclife told if big corporations like Microsoft cant achieve what they, want who are we? Does this mean we shld quit and resign our fate. Live another day, Fight another day till we achieve what we want.
I contribute, i participate in the calls, i write to the reporters, i send faxes and emails to Senators/House Reps, Appear in Newspaper & Radio interviews and most of all Spare a Prayer to God to improve my situation. That is all i can do and if every one of us does what is needed sure something positive will happen. I am not a CORE member, just an ordinary member like YOU.

I have checked receipt# and it was my wife's new H1 approval not my H1 transfer. Her H1 was returned to USCIS as non-delivered and I think this must be duplicate copy status update. I've used CiTibank's Global wire transfer service (from my US CiTibank account to an Indian HSBC account) and they charge $30 for upto a few thousand dollars wired per transaction.
As I understand it, CiTibank does not charge any money for wire transfers from the US to India, PROVIDED the transfer is between two CiTibank accounts. I have not tried this yet but am planning to set up a CiTibank account in India next time I'm home .. the $0 transaction fee seems worth it.

Does you think it might be possible that USCIS could hold the AOS application and automatically process the application with out any refiling cost ...with or With out encashing the checks...
This solution might be a possible fix to all Folks even if their PD comes in OCT Bulletin ....
