I work as a dentist in a company which was held in partnership by 2 partners.I have a approved H1b and my I 140 is filed.Now as of Oct 01 the orriginal company is finished as the partners have seperated.I am confused about my case, if I have to file a new H1b and 140 or an ammendment or just nothing.The tax id number for the company has changed.As for me my work location has not changed and I still work in the same position.Can I take paychecks from the new company which now belongs to one of the partners or do I need to inform immigration.Any advice is appriciated.

I contacted one lawyer who quoted $750 for G-28 + AC21 + informing me of any RFE. If RFE is simple like DOB certificate +EVL certificate she will help as well. If it needs more work she will charge separate depending on nature of RFE. The agreement is a bit vague on how they will charge on any RFE. I havnt yet signed the agreement.

The budget recon bill had a conference committee on Dec 21 where the sections 8001 and 8002 were dropped. These sections were for eliminating the dependents from couting against EB visa quota and other retrogression relief.
The anti-immigration groups like FAIR and numbersUSA had a party that night in which they pinched needles in the voodoo dolls of Arlen Specter.
Ok...I made this sentence up.
But anyways, those goodies were dropped in Dec and the house finally approved that version which was finalized on Dec 21.

My employer and I have started the processing of my green card and we already have the Certified Form 9089. Before we file for I-140, we would like to know if this is an EB2 or EB3 category so we can use the interim rule on the concurrent filing of I-140 and I-485.

Agree with most of what you say, but I do not think processing of I140 is happening based on whether PD is current or not. My PD has never been current but my I140 got approved a couple months ago.
I agree. My PD (4/2003) has been current all April 2008 and I haven't seen any LUDs. On the other hand, I am seeing scores of 2007/2006 PDs being approved when their GC opportunity if years ago (Sorry guys!!).
In line with the theory I heard last year about USCIS allowed 100s of thousands of people to apply for AOS in July/Aug 07 because it would generate a huge stream of revenue, this non-PD-based-approvals seem to validate the same. Approve I140's, keep guys on the hook for I485 and get them to keep paying for EAD/AP approvals year after year

More likely H1 transfer would not work, but it does not hurt to try. What about filing a new I-140 using the same employer for another category (i.e. EB2) before H1 expires and then extend H1 based on a new pending I-140?
why would H1 transfer not work?
I was able to transfer my H1 in my 7th year based on an approved I-140. Got 3 years. Plan was to restart GC with new employer within that period. Per the attorney the status of the H1 is ok even if the underlying I-140 is revoked. Doing a ton of research online, atmost the status of that H1 is a gray area; however could not find any case where USCIS has come back and revoked the h1 because the underlying I-140 is gone.
The current USCIS interpretation is that the H1 remains valid for the period its granted for.
Dont transfer for a 1 year extension, you wont have time to extend your H1 again if I-140 premium-processing is not re-introduced...

If TSC refuse to process applications with RD before 4/30/07 they won't get to the majority of the early PD EB-2 India.
As shows, Nebraska is processing June 2007 applications, so they are busting ahead.
Googler, I believe that was what HereIComeGC's question was partially about. Why is TSC stuck in Apr 30, 2007 whereas NSC has moved to June 2007 at a faster rate?

I don't think that was proper but that's what his accountant did on his returns. The morale of the story, you can oopen your own business but better talk to an immigration lawyer and an accountant.

I wonder, economy is so bad that people started jumpimg from high paying job to low or ...Anyway AC21 is not must..you should not worry..go get it..is one & same ..as long as you are in IT. ..GC too far ..who knows might have to invoke another AC21 in between these years again then if do now...so my advice..don't do nothing, if your original employer agrees not to cancel the I-140...GL

CA DMV is completely clueless about immigration regulations. I had the same problem - Finally I took an appt at the deferred inspection center (San francisco) per the advice of the Infopass officer. I was on a temp license for close to 9 months.
The DL was sent to me within a day after I took the appt. There is a team at the deferred inspection center that does the immigration validations for DMV. They can directly contact the responsible person at DMV, and get the issue resolved.
444 Washington Street, San Francisco,CA 94111 - When you take infopass, you must enter your zipcode as 94111 - So you will get appt at the SF USCIS center.

According to the EAD/AP instructions it is clear that one has to pay the new fee every time you apply for EAD or AP if you haven't filed I-485 under the new fee structure.
Contrary information is always useful to all of us but which are they? Please send a link so that it will be helpful to all of us.
Read the string of USCIS memo relating to this and you will see why I ask this question.

It takes forever to get hindi app., even I had to opt for english app. for my in-laws. Just waiting with my fingers crossed.
