Exactly ...in other words, say on one of the pages a signature is missing. would USCIS reject the whole package ?? if they do reject after aug 18, will they accept the rectified form again ..I would think that they should accept it ...if they dont, then such unlucky souls will be in the dumps for a long long time.
They will NOT accept the corrected applications after 8/17 unless it was rejected in error. That has been their practice for long!

I have read almost the entire section on AC21 in this forum. However, I am still confused to whether the sponsoring employer can revoke I-140 after 180 days of I-485 filling?
My 180 day period is maturing by end of Jan 2008 and my employer is giving me bunch of bulonay. My I-140 is still pending and I am not sure if I can stick with this company for another 5 years until my green card gets approved. I was thinking of using AC21 portability rule to get out of this deadlock as soon as I get to the 180 mark of my I-485. Any ideas and suggestions will be much appreciated!

Yes it counts a lot. I guess it is for 1-2 years, go for evaluation ASAP. I too have same from private institute plus another diploma of another year. It worked for me.

He worked for A (old company) till February, then changed to B. I think the intent is to collect the year-end bonus and other dues from A. IRS doesn't care which company you worked for, under what visa. The only time you get into trouble is during Visa interview in India.
My colleague knew he would be in trouble @ chennai consulate. He got his visa stamped in Mexico. There is an element of risk involved. If you get caught you could be in serious trouble, including permanent bar from entering US!

It's how you react to situations, experiences, or folks that are "not normal" that really says whether you're a polite, cool, calm or whatever type of person you want to be, or whether you're an impolite, rude, angry or abusive person who cannot deal with such situations.. imo.
Not trying to get into a flame war here... I simply found the way you start your reply amusing - sort of a disclaimer or a protective shield saying normally I'm not like this... comparatively, a murderer would say normally I don't murder, but given these unusual set of circumstance I couldn't help myself but kill that person... :)

Thank you all for the useful information. Today I had a consultation with one of the senior attorneys from Muxxxx law firm. She says that cross changeability is applicable to do so. The same is mentioned by the senior and other members in the thread.
In accordance to my actual question, lawyer told me 2 options.
option #1: apply EB2 with the current employer for the future job (by promoting or similar job role change). But in this case, risk is there, high possible audit expectation, spending money and time. Audit could take more than 1 year.
option #2: change to the new employer and as per the job requirement do the EB2. This is smooth sailing. Audit expectation is less.
I'm not sure still what is the best option to go with. I really appreciate your suggestions and comments. Please help me to find some clear path.

I tried to give you green for your post but it doesn't allow me it says "you have to spread reputation before ..." anyway i don't understand this message either.
1. CPO mail (usually email): Card Production Ordered email: an email from USCIS that states that they have ordered the production of your green card - meaning that your I 485 is approved and card production is ordered; usually takes 1-2 weeks after that email to receive physical card.
2. SLUD: Soft LUD (LUD = Last updated date). means that your case in your USCIS portfolio (the one that you create online under my case status) shows that your case was last updated on date so and so, but actual status stays the same (like initial review, RFE, etc). This does not generate SMS or email message for update of case (if you signed up for it under your portfolio). Generally means that someone touched your file.

I was thinking that maybe you can make some form of contract with the person who gets your money (trustee) on condition once you get a GC to be able to restore the money from him/her. Do you think that would work?

Either approach is illegal and trying to hide the money or the reality of the situation is foolish. People have been trying schemes like this for many years. The USCIS isn't stupid.
I know several doctors who created corporations and then sponsored themselves for GC without problems.
It is difficult, if not impossible for computer professionals to sponsor themselves for a green card using their own company. Such a filing can be rejected at labor cert or at the I-140 stage. At labor cert, the DOL will challenge you that the job is not open to US citizens, since small companies don't usually hire people to replace their founders. Also, since the immigrant themselves can have no role in the hiring, it becomes even more complicated when it is a one person company. I doubt such an application would even make it through the PERM process.
At the I140 stage you would have multiple problems. The first is ability to pay. The second, according to 8 C.F.R. 213a.2(a)(2)(i)(C), an immigrant with a "significant ownership interest" in the company comes under extra scrutiny. The USCIS implementing regulations define "significant ownership interest" as five percent or more. There have been plenty of court cases where people founded corporations to sponsor themselves and the USCIS rejected their green card applications. I can't remember the names off-hand but if you Google the topic, you will find the US courts have dealt with exactly this issue and rejected it as a way to receive a green card. Doctors may get off lightly under a different law (I don't know), but for the rest of us, it is not a realistic option.

Right, but it`s not only the Dems that they are agianst the Touch back provision, also the Chambre of Commerce and others istitute. It`s not looking good. If they can compromise about the touch back, (exemple 2 weeks? ) we can have something on the table.

Guys whoever planning to use EAD going forward get ready for $700- per head out of pocket every year. That is the cost of renewal for EAD & AP without attorney involvement. Add additional family members and you can understand why was July bulletin made current.

There are 2 things which we aren't sure how to find for the Employment Verification letter for AC21.
1)USCIS needs a letter that states "same or similar occupational classification as the original employment." -
How do we find the orginal occupation classification if my ex exployer is not ready to share it. I only have my PERM case Number.
2)"The letter should also indicate whether the terms and conditions of your employment-based visa petition (or labor certification) continue to exist.".
How do I find the terms & conditions of the original employment?

USCIS is supposed to give a weekly update on receipt status - every Friday at Close of Business. There is nothing yet for Aug 31. Past few updates were also late, some questionable on the status reported !!!

Your help on the matter is appreciated. I am EB3-I. I filed for I-485 in July-07. I have been working on H1. Now I am going to switch to EAD by AC21. My new job has same job title and job duties. They have another condition for job. I will have to have a Masters in 8 years of starting my job.Their basic requirement is still Bachelors but Masters condition is kind of extra condition. My question is does this give me any trouble for my GC process because of Masters condition.Another question is will I be able to switch to EB2 based on this.

Many of us were got stuck in name check, how many year it will take,
no one know right now.
but the issue will not resolved, since no one care except us. CIS said it was FBI's problem and everyone has to EAD,AP renewal every year(over $1000/person). Lawyer also get fat fee on this too.FBI don't care these issues at all, it also good excuse to get bigger budget.
Here is we may can do: Ask CIS issue temporary green card which will be renewal yearly(cost will be the same as AP+EAD) if name checking was pending 6 months or 1 years.
Temporary green card was the same as permanent green card except one year renewal. so we will get green card and INS still get their money.

I still don't understand how this is going to solve the problem. Our problem is with limited visa numbers and quota. How can premium process would make 485 fast?
Like I said in my first post, this is independent of retrogression. But we all know the backlogs that can develop and then take years to clear. A premium processing option would give people a choice between a fixed fee and an uncertain wait.
