How one will know that employer withdraw's his I-140? Is he will see any update on status or how one can figure out this?

As tamil12 said you cannot use the new ap which was approved after you left. If you use that you enter you are inviting unnecessary problems for yourself. Enter before the old one expires and the use the new one for your future trips.

There is one more question regarding I-94 (Bottom Part of Approved H1B). I am planning to go to India and have approved Parole Document . When I re-enter US, I am going to use AP.
Now, question is- While leaving US, Should I turn in bottom part I-94 ,of I-797 (H1B Approval ) along with the Form I-94 (which is stapled with passport) which I filled in when I returned to US during last trip ?
To my opinion, all the I-94 should be turned in ( The one with approval and also the other one when I re-enetred US last time). But any other thoughts would be helpful.

For those who doubt about cache etc... Ctrl-F5 will make sure your browser get the latest copy from the server. For now, seems like they change the page back to March, 15 page for NSC. No sense to keep trying...=)

I had called USCIS and my NC is cleared but the problem is the processing time, they are still in July 16th 2007 and our RD is Aug. 6th 2007. I am hoping that they catch up and move dates same as NSC.
My GC was approved last year... Its been almost a year and my wifes application is still pending! 2003 PD... She has been current for months now and nothing has happened... We took and infopass and the officer said its stuck in name check, but now with the 180 days rule he said it should get approved anytime and that we should have patience... This was 3 months back! Still nothing... :mad:

Simple legal way is, find out any of your friend planning to send Dollar from here to India , instead of them sending dollar from here , you pay rupees in india and get the check from your friend here in dollar as your amount is relatively small.

I got an RFE too for both me and my wife (and we're not current either) ... wonder whats going on!
First of all, thanks for sharing the info! Some questions:
- When did they mail your RFE? (Mine was mailed on Oct 3 but havent recieved it yet)
- Did you receive it or did your lawyer recieve the RFE?
- Do you think a visa number has been assigned to your case or my case under Sept Bulletin?
- What do you think will happen after they recieve your response? Would they issue GCs or will they file the applications till your PD gets current again?
- Are you using a lawyer to respond to the RFE or are you doing it on your own?
- Would your lawyer charge for responding to RFE? (I'm under the impression that lawyer fees for RFEs are covered in the fees paid during 485 filing)
Dont mean to interrogate you but just curious as I'm in the same situation. Thanks!

I'd exact same experience in 2004. Anyway I found out that after 2 months
of I-94 Expiry. My atty ( Murthy ) gave me 3 options
1. Correct I-94, by taking it to Port of Entry ( I couldn't do since my passport and H1B visa and all those
documents were lost when I sent to stamping visa. I'd only I-94 since I sent a copy.... I was in fire at that time :D :D )
2. Get oout of the country and stamp visa and get in ( was not feasible for me for the same reason)
3. Do an H1B amendment, saying a slight modification in job description...
So I took the 3rd option since I'd copies of all docs.
According to my atty this is a grey area in the law. When I took everything to the Local INS office they said me, it doesn't matter the present I-94 is not valid, since I've an older H1B which is still. But please note that all those officers are not well informed. So I did not buy it. My atty told me that I could get a query in the I485 stage, but he said that I'm perfectly okay with 245(K).
After this incident I travelled out and came back in using parole. I did not have any problem. So I guess everything is okay.

I dont understand the question well. If you mean the trouble I-94 expired, Yes its expired. It is our responsibility to look and make sure everything is okay when we leave POE. If there is an error ofcourse we can appeal in the future. On most cases the decision will be favorable to us, if the mistake is genuine one. But nobody wants to get into all these hell and go for appeal, RFE reply blah blah...Send me a private mail with email so that we can be in touch. I will let you know if I get any query or any junk in the future.

does anyone has any link or documented proof that i-485 cases with i-140 approved from texas will be transferred to texas? I believe it is nothing but speculation.

Its a myth that numbersUSA is amenable to reforming green cards without increasing H1-B. The anti-immigrants will still cause a huge uproar if there is any increase in EB visas. They dont want to see additional immigration period. The only clauses that can possibly get through unscathed are those that do not increase visa numbers - things like filing 485 without a visa number, more mobility with EAD etc. I am starting to believe in this "silver medal" theory that has been doing the rounds on this forum - Last week showed that the anti-immigrants are fervently opposed to even re-capturing visas from past years let alone even a temporary increase in visa numbers. To say we are in for a very tough battle ahead would be an understatement.
