First of all, thanks for sharing the info! Some questions:
- When did they mail your RFE? (Mine was mailed on Oct 3 but havent recieved it yet)
They mailed on Oct 2nd, my lawyer received it yesterday (Oct 7th)
- Did you receive it or did your lawyer recieve the RFE?
The Lawyer
- Do you think a visa number has been assigned to your case or my case under Sept Bulletin?
My lawyer said thats a possibility, but she said you never know what they're up to. In either case she said its a good sign that they are looking at our case.
- What do you think will happen after they recieve your response? Would they issue GCs or will they file the applications till your PD gets current again?

I think there is something called 'last action rule' or similar, which basically means that if you entered the US again and got a new I-94 card, then your past transgressions are forgiven/pardoned.
It would have been worse if you stayed and did not leave the country. In my humble opinion, your lawyer is wrong about this.
Check the I-94 threads on Murthy forums, you will get more information.
Of course speaking to an independent immigration attorney should be your priority # 1.

Thank you for your advice. sorry but I have some follow up questions:
1. do I need to file for CP while I am still in the US or can I do it from my country?
2. CP will be based on a green card for future employment. so am I going to need a Employment verification Letter when i apply for CP? because when I leave from here, I don't think my current employer will provide me with a EVL if I need it in the future.
3. can I find another employer for a smiliar job that can provide me with an EVL in case I need it in the future for CP??
4. do i need to keep an address here in the US ( like a friend's address) for immigration purposes while I am living back home? or a bank account etc.....
5. regarding SSA, I have been contributing since 2002 (9 years) short of the 10 years requirements. is there anything I can do now so I can still get benefits when I turn the retirement age

Guys,
I have contacted lawyer Kempster based out of chicago and as per my reviews they are the best lawyers in Chicago,IL.
As per him..we don't require any legal assistance unless we receive RFE.He declined to offer me any assistance for AC21 and he repeatedly said don't do AC21.Just do AR11 only for address change.

I am pretty sure every body has already noticed that the first page of this inventory data report from USCIS says "at Texas center".
That should be a typo, Definitely this is the total volume of EB 485 pending at all office.
Just check the Texas Service volume trending as of July 2010 which shows less that 130k I-485 at various stages as opposed to more than 168k EB 485 pending from the inventory.:D

Two options

I don't think you can stop Employer.

Please note, if you have a house you must include only the equity you have in your house - not the market value. So you must deduct remaining mortgage and estimated selling costs from the price of your house.

This is one of those grey areas. USCIS has allowed self porting provided all conditions are satisfied. There are some old posts on Rajiv Khanna's forum, but a fresh discussion always helps.
If anyone can write a detailed blog - it will be helpful to fellow IVans.
In this challenging job market, a lot of people maybe wanting to self port and work on contracting assignments till companies have enough budgets to hire permanent employees.

IV Friends
Congratulations on success of rally. this was a huge success.
I could not come in person to rally due to personal reasons,
but our wishes were with us all.
Fantastic job done. This event will go as a huge success in annals of history.
The rally was a start, with so much energy for a true cause lets pump some more steam in our efforts.
Now is the our duty who did not get to attend the rally to give IV Rally heros some rest, and take on work for next steps.

Great enthusiasm everywhere. Individual states may not be good location, because you may not be able to pull a lot of crowd, a common city like DC or NYC is would be most ideal place.
DC rally was in the cooking but it is on hold for now.
Going by how little response we got from DC people for the flower campaign to our please to go to USCIS on the day of the flower delivery - I am a little sceptical about the success of the DC rally unless we get a good infusion of people from outside.
DC rally will probably be the most important one so it has to have superb planning and execution and it has to be on a working day.

The lawsuit was filed Friday in federal court by Gabriela Ptasinska, a Polish immigrant who has a temporary work visa sponsored through her job at an engineering consulting firm. It is among the first challenging the U.S. State Department's decision.
In June, the State Department announced that employment visa numbers were available for all people seeking employer-sponsored green cards, except unskilled workers. The announcement meant that as early as this past Monday, Citizenship and Immigration Services would begin accepting applications, which require a lengthy process including certified documents and medical exams.
But an update posted Monday on the State Department Web site said 60,000 such numbers were no longer available because of "the sudden backlog reduction efforts by Citizenship and Immigration Services offices during the past month," meaning no further applications would be authorized, effective immediately.
The department called the backlog reduction efforts an "unexpected action" and said employment visa numbers would be available Oct. 1.

related to Employer-Employee relationship issue. Most of the time employees of consulting company are the one facing this issue. If work location is different from the company base address then question about the client and project raises, which most of the time turns out to be difficult case to prove employee-employer relationship and they end up with 221(g).
Companies needs take initiative and work with their lawyers to make sure employees are not affected during the trips (to home country), but very rarely company takes care of this without any issue pops up which is very sad.
221(g) is rampant in India nowadays for IT consulting companies.

Thank You IV for doing this for us.
It was great to see the positive response from staff members of congressmen that we visited, not one of them opposed the idea of reform to this process.
I've had the time of my life at this event. I almost feel guilty for having all the fun that I did in the past three days, and a bit sad to leave my new family. IV simply rocks!!!
