They are working on your application - Prior to fiasco, if you see a LUD continuously for 3 days, it resulted in approval. After the fiasco, LUD and online status unable to predict the actual application status. Keep looking periodically, you will have a magic email.
My LUD is changed 11/6 and 11/7. What does this mean? Are they working on my case on 11/6 and are they taking any decision on 11/7?

I am on EB2 with PD dec 2006 and will be filing for 485 and i140 is pending. Being single and marriage date not sure, i may not got much benifitted by EAD/AP. I still have 3 years of h1b. I work for a non profit organization on IT side ..good thing is very secure and very easy to get GC. Bad part is pay not competativ enough with private companies all though good enough to lead a good life in US.
I have got H1b done from a consultancy and now i am the delema to jump to private company or not as i still have 3 years of H1b. But the very fact that i need to go thru al the process of GC again makes me think twice. The fear fo regretting is making me not to take chance as the 485 dates became current. Also i feel i can alaways think of climbing the career ladder after GC. In brief i am bit confused as i have many options.
I would apprecite if you throw suggestions on this situation.
Although eventually i will take the decsion which is good for me.

I say apply your I-485, after 6 months you can use AC21 to jump to another company. The downside is 'what if' the 'other' company lays off you.

I got 1 year with 3 months eaten up. I am EB-3 India 2004. So I am going back with the fee check next year again. What a greedy system..Nothing on this earth can beat USCIS for being the height of being 'irrational'

I take it that you are under retrogression. You could use AC21 and be on the EAD, provided the new job is similar in nature. Check with an attorney.
H-1B after 6 year period is derived from the pending GC application. If your GC is rejected, automatically your H-1B is also invalid. As you are on H-1B extension beyond 6-year period, it does not matter if you are on EAD or H-1B. There is no switching back to H-1B unless you leave the country for one year.

1. To have any small impact we should have 100s if not 1000s of people mailing their credentials.
2. There should be a date decided around which everyone would mail their stuff.
3. The mailings should be to atleast a few common addresses (maybe some prominent senate and house members).
4. The cover letter should be common for everyone, expressing why we are mailing these degrees.
5. The personal letter should be ...well....personal.
6. We should not make any markings, coloring on the degree granting instiution's name as a mark of respect to the alma-mater. Maybe we can put black dots on the edges, or something symbolic of this nature.
If there is sufficient interest among IV members then please let it be known on this thread immediately.

I would like to hear from folks who are thinking about their own lawyer. How do we answer RFE's if we hire our own lawyer? Are you hiring your own lawyer because your company is willing to work with any law firm? (or) Do you feel that I 485/EAD/AP has nothing to do with employer ( assuming I 140 is approved and not used/using substitution labor ) and the RFE's will be pretty much personal. How do people who joined new employers after 180 days answer any RFE's esp if the previous company and law firm is not willing to co-operate?

They are processing concurrent July (07) filings only for ROW. You don't see many India concurrent filings being processed. This seems to be intentional because otherwise you'd see some concurrent filings being touched. So USCIS must be doing this either to punish the July concurrent filers (not likely) or because they think visa numbers will not be available for these people even if the 140 is adjudicated. But that is not true - this is a problem for a lot of people whose priority dates have become current during the past year. We should contact them about this.

My situtation same as yours (without the GC :D). I will be traveling India this December. I have valid H1B (not stamped) and AP expiring on October. Do you recommend me to get H1B stamped in India and not worry about AP (in that way I can save money) and enter as H1B from India. What will happen if my GC gets approved when I am in India? Will I be able to enter with H1B without AP? Thanks.
My 485 was approved while I was in Europe last week. I have a valid AP and H1. Entered US through Newark yesterday - went to the permanent resident queue. Told the officer my situation - showed him H1 and the 485 approval print out from uscis website. He wanted to make me enter on a H1. I then showed him my AP, on which he said I had to go "downstairs". (I have had AP since september last year, had never used it earlier though I have had multiple trips since then. Preferred to use H1).
Went downstairs for secondary inspection. My 485 approval print out was not part of the "package" left on the officers desk by the escort.
When called by the officer, I showed him the print-out. The officer was a nice person - said "you're throwing so much stuff at me. You have a valid AP, a valid visa and now you say you have a GC too?". Anyway - he looked through the system - and said "yes, you are a permanent resident - congratulations !". Tore away the white I-94 form which I had filled just in case, stamped the passport with the date and wrote "LPR" where they usually write "H1B" and that was it. Took about 20 minutes out of which 15 minutes was waiting for the officer.
Hope this helps somebody.

One of my friend, he came here last DEC 2005 from India through Atlanta based consulting company. My friend paid for his H1, he paid for Air ticket to come here. The company never gives any support to find his project. They did not give him accommodation and relocation. NOTHING from the company side for the past 1-year� we friends helped him by providing accommodation and food. By this FEB end his H1 is going to over (first 2 1/2 years approximately, he came after one year from approval). The company is not helping him by applying extension. Now he got one job, his company is not willing to sign the contract for this project. (Reason: They have to apply for extension, But they are telling their attorney advice them not to sign the contract since he is here for an year without their support, that will give a problem to the company). There is no other way for my friend other than to transfer his H1 to some other (good) company� but He doesn�t have a pay slip� What to do? The entire fault is from the company side, but my friend is suffering. (He spend his H1 cost + Air ticket for nothing�) Is there any solution for him? Please kindly advice /suggestions and Ideas�

I don't know whether 140jibjab is actually guilty of domestic battery. If he/she is, I am incensed that we are helping someone charged with domestic battery. Why would you beat up your spouse?? And then have the guts to ask for help in a public forum.

I can only hope that you do not discriminate on the basis of race, color, gender, religion, age, sexual orientation, national or ethnic origin, disability, marital status, veteran status, or any other irrelevant criteria when it comes to an Immigration forum. The last I checked, IV sure doesn't and I sincerely hope its members don't either.
I never recommend one lawyer over another, but I think in cases where there may be a conviction in misdemeanor or felony.
Unless the accused has a history of domestic battery, first time offenses are classified as a Class A misdemeanor. If a history of domestic battery is present, the case is upgraded to a felony.
As always, please consult a qualified lawyer and work towards resolving the situation favorably with the other party. Laws vary from State to State. Since you haven't mention which state you are from, I would recommend that the legal interpretations you have read on this forum be disregarded or conferred with an attorney before you take matters on your own hands (or spending ridiculous amounts of money on subject matter lawyers).

Yes, you can. As long as you worked legally for your employer, you have nothing to worry. Never leave such idiots alone, go ahead and file a case or sue them.
