If your I-94 expires then your H1 ceases to exist as well and you will have to update I-9 to reflect that you are using EAD. The dependents will have to use AOS status as well and lose H4 status.

I know I said compared to India. 12 hrs is the worst time difference.
UK Client BPO in India are far better off time wise than the US Client BPO
in india.
Plus China US flight time is also less. 10 - 11 hrs or so in direct flight.
India its around 20 - 24 hrs (except the few direct ones started recently)
The flight is very exhausting.

I have been noticing soft LUDs on my EAD and 485. The EAD was issued about 2 months ago and I have had 2 soft luds on that and on the 485 in the last week.
Any ideas on what that means?

Forget about EB2 with 3 year degree.
Now a days, even EB3 is difficult with 3 year degree.
EB3 is possible, if job description not mention about US degree equivalent.
Make the ADVT. wording to suit 3 year degree, associate degree or no degree for the post.
You cannot combine experience, PG diploma to add one more year to your three year degree to make equivalent four year US degree.
I know one person got I-140 denied, even after 3+1+2 year degree. He got PERM certified, but I-140 is denied for degree(EB2), even though he have 2 year masters from India.

Totally incorrect info.

My RD is July 24th and they are processing July 30th. I guess my question is, what else can the officer do after namecheck and before preapproval?.
One of the most important things that an officer can do after namecheck etc. is to actually work on your application....The way things are going at these service centers, I dunno man...Good Luck though..

We should get out blessings from IV core team, without their help, this is not going to be visible to the concern people.
USCIS has their own law and rules, I will not suprised if I-140 takes 3+ years to get approved. We have seen how the labor ( pre-PERM) used to take 5+ years to get approved, now PERM should take less than a year. Either way, USCIS has the final say, now it's I-140 turn, who knows, what will be next.
Lets work together, we can achieve great results, the power of people is much more than the mighty Himalaya!!!!

I came through JFK two weeks back. I used AP and no questions were asked. The officer was confused that my AP was expiring in 2 weeks and I have not used it at all. In the secondary inspection, the officer could'nt understand that I have not received my green card yet since my 485 has been pending for 6 years now. I got to explain to him about the delay for EB3 I and visa numbers. Nothing else was asked.

I have my PERM approved 2 months back in EB2(BS+5), my current salary is around 7K less than profferd Wages. Company is small with 40 employes in US and around 30 in UK/Japan, however company is still not making profits but has funding for next few years. I am in 6th year of H1B with 7 more months left to complete 6 years. I want the company to apply for I-140 in premium processing, however, company attorney is saying that I-140 premium processing might attract RFE for ability to pay issue, So he want to file I-140 in regular processing. I even offered to pay premium processing charges, though company is paying all other charges but attorney is still not willing to file under premium processing. Is it true that PP attracts more scrutiny than regular processing. Any Ideas? Any suggestion on how to convince my HR/attorney to file in premium processing. Any suggestions/Comments are welcome

I still don't understand how this is going to solve the problem. Our problem is with limited visa numbers and quota. How can premium process would make 485 fast?
Like I said in my first post, this is independent of retrogression. But we all know the backlogs that can develop and then take years to clear. A premium processing option would give people a choice between a fixed fee and an uncertain wait.

After I-140 is approved, Can the geographic location be changed with in the same company and same type of work?, but manager will be different. Tried to search to google and Immigration voice, could not find any clear answer. Heard different answers from different friends.

I have done this myself and its ok to change location while GC is in process.
I have asked my own company lawyer, and since I wanted a second opinion, I talked to another lawyer also at my own expense to double check. I used to work in Phoenix AZ and now I work in Reno NV for the same employer. I moved to Reno after my labor was filed for my job in Phoenix AZ.
Here is how it works.
GC is for future job. You can work for anybody anywhere while your greencard is in process. That is the conventional wisdom.
Now, in your case, you are changing your work location for the same employer while your GC is in process. That is fine. However, it has to be the same job description. If you are a C++ developer you cannot start working as a project manager. (On that matter, even if you continue to work at the same location where your GC was filed, your job description must not change. So dont accept any promotions. )
When you 485 is filed, and you are working at the new location, there are 2 things to keep in mind.
1. If your 485 gets approved AFTER 180 days of filing, then AC21 option is available under which you can not only change your employer, but also your location. So in that case, you working at this new location is not a problem. (the job description must still not change even after 180 days, whether its this employer or a new one). There may be some paperwork you need to do to use your AC21 job portability options.
2. Now, after your 485 is filed, if it gets approved in less than 180 days, then your AC21 option is not available to you. In that case, immediately after getting your 485 approved, you have to start working at the location and the employer who filed your Greencard. And in such a situation, I was advised that I should actually move back to Phoenix(where my GC was filed) and rent and work from there for atleast 3-4 months after I get GC. However, this is very very unlikely to happen since 485 getting approved in less than 180 days is very difficult to achieve for USCIS since there are so many other agencies and departments involved and USCIS alone cannot revolutionize its process and start approving 485s in less than 180 days. For that, they will have to have co-operation from FBI in namecheck issues and DOS on visa number issues to expedite.
So in a nutshell, go ahead and start working at a new location but tell your HR or boss that you would have to go to original location and work from there for 3-4 months in a rare 1% chance if your 485 is approved in less than 180 days time. And yes, dont accept any promotions, at 140 stage or later stage otherwise you can get in trouble. Just stick to the same job description.
Now, at the end of the day, every case is unique and its always a good idea to spend 150-200 dollars for a phone consultation with a good immigration lawyer and get a second opinion. I am not a lawyer and my advice applies to myself and there is a small chance it may not apply to you. So before betting your career on forums' advice, it would be good to talk to a lawyer.

Trains & governs XYZCOMPANY QA Assurance processes/methodologies and later governs IT methodologies.
Leads UAT testing efforts by working with UAT participants to ensure proper methodology, processes/expectations are followed and met. Insures quality even in the highest pressured environments.
Ensures project processes are followed, accurate, complete, and that the business requirements are met. i.e. the customer needs are met.
Ensures quality is not sacrificed for the sake of only completing project objectives.
Monitors IT Product Development Groups processes and metrics.
Trains/mentors QA team members according to QA disciplines placed into action. Establishes & rolls out metrics on findings.
Provides an assessment to XYZCOMPANY IT Managers for XYZCOMPANY software project releases if they are not meeting an acceptable level of quality via QA governance findings.
Makes inquiries on environments used for testing to make sure they meet standards.
Researches new products/industry methodologies - facilitates the development of new concepts, techniques, & standards.
Produces metrics for area of responsibility both on a regular and an adhoc basis to include on IT score card.
Promotes/ensures that QA and Organizational Vision, Values and Goals are followed and achieved.
Provides input to the development and then feedback to the manager on Team Member objectives and targets. (360 degree feedback)
Supports and enforces Conflict Resolution process; handles escalated issues.
Defines touch points, review process, audit process to ensure staffs adherence to practices.
Leads/participates in completing the work on multiple projects within a release which may include scheduling, time estimation and resource needs for all approved projects.
Creates/develops templates & checklists to better assist tm's with their work.
Defines, strategizes, implements, and communicates plans towards ideal future state.
Develops strategies/prescribes steps designed to ensure results are achieved & rules are in compliance w/standards.
Basic Qualifications
5+ years IT quality assurance and systems/application testing experience.
Minimum Qualifications
4 year degree and 5+ years experience or equivalent combination of education and experience to be defined as:
4+ years experience in developing test plans, test cases (manual, automated, or performance), test procedures, test scripts, expected results, and the usage of a testing tool. Preferably, Quality Center, Quick Test Pro (QTP), or LoadRunner.
Proven ability to understand complex test environments and configurations, and manage testing efforts from planning through to execution.
Ability to handle multiple projects and directives and work in a fast-paced work environment.
Demonstrated understanding of project management, project planning and risk mitigation experience.
Proven leadership skill sets (Build processes from the ground up and coach others on processes)
Excellent verbal and written communication skills.
Ability to effectively communicate with individuals within all levels of technical and non-technical roles (Developers, Project Managers and external Customers)
Demonstrated ability to meet deadlines with acceptable levels of supporting documentation.
In depth understanding of the Software Development processes (Agile and Waterfall) and Testing Methodologies.
Understanding of the approach of working on agile teams versus waterfall teams.
Strong analytical and problem solving skills.
Must have proficiency with the Microsoft Suite tools for projects.
Preferred Skills
Experience in all phases of the Systems Development Life Cycle (SDLC).
Experience in leading QA teams, and their work efforts.
Experience in defect tracking, reporting, and metrics for testing.
Experience and understanding of client server and web architectures.
Experience and understanding of application servers.
Experience in data testing and in understanding database servers.
Experience collaborating on projects with Project Managers / PMO office.
Exposure to diverse platforms and operating systems, including current and emerging technologies.

how much should one get for husband , wife (non working) and two children? i got 1500... is that less? i think i got my rebate without SSN for my child... he had only a TIN...
Unfortunately, We got the rebate for 3 of us who had SSN and not for my son with TIN. But I will get it back from IRS this year..:D
