My lawyer was getting ready to file Friday, due to this new development I asked them to wait until Monday....not sure if that will be enuf though...it may drag on forever, In taht case I will ask them to file anyway on Tuesday.

It is mandatory to inform USCIS about the change of employers. According to an article on murthy.com, USCIS had denied the 485 in a case where AC21 was invoked, and USCIS was not informed abt the employer change.

Can some tell me the list of docs that shoudl be submitted for the 485 filing,.
I check the USCIS website and it say nothing about
- W2 or Tax documents.... only a letter from the employer confirming AOS application

One my friends told me that he had 11 H1B approvals during 1999. There are no restrictions on the number of H1B approvals one can have. I know people working part time on one H1 and full time on another.

What about all that BS that if one does not start work by Oct 1st 2007 then one could be out of status. etc.....My wife will be contiuing with her full time H1B JOB with CAP EXEPMPT employer which she has had now for 4 years..! Her H1 is already valid till march and her employer has already said that they will extend h1 too for remaining 2 years.! I mean if the consulting company refuses to co-operate with us by not sending the letter to withdraw the new H1 peitition then it really is his loss... isn't it..??...Are there any USCIS or DOL laws which state that i have a right to get copies of all these docs like LCA, 129, letter, etc...! even though i will not work for that employer.!..I mean there should be something protecting us right..!!

I am on H1 and my wife on H4. My wife is also an expert in the art of embroidery and handicrafts, she's become quite famous for her artwork locally. A wholesaler has approached us recently expressing his desire to market her handicraft to other indian stores in the area and beyond. I checked up some info on registering an homebased business and they don't ask you to submit an SSN for registering a proprietary bussiness either at state or local level. A federal or state tax-ID doesn't seem to be an requirement for homebased business either. They just ask you to submit a schedule C attachment with your regular 1040 form when you file tax return.
My questions are following ?
1. If I register a homebased business in my name and include it with my personal tax return, what are the possible implications ? Does IRS or the state business office share info with USCIS regarding business registrations or the only way USCIS would know about the business is if they see my tax returns ?
2. Any other alternative/creative ways to handle it ?

The real catch are not these 12 mil illegals. which politician would bet on these folks who may or may not vote them in some distant future. Every one of these 12 mil illegals probably has one legal citizen as family/friend or whatever. This net is being spread out for those folks. Even if it's 1 citizen for every 2 illegals, it's still 6 mil.

Friends! Please shed some light on the rights that an EAD holder has. I am sick of my present company due to their unprofessional attitude. I have EAD since Jan 2005. What I need to do to join some other company? How risky is it to join some other company? For how long a person on EAD be without job? This will be the first time I shall be using my EAD as I am currently on, post 6 years extended for 3 years, h1 with the same company. So would it be better if I don't make use of my EAD and use my h1 instead to join another company?
I dont know you have any exclusive rights with EAD.
I prefer using EAD (that is what i did 2 years ago) rather than another H1B , with EAD you have wider choice and you can eliminate the middleman and hence increase the pay rate .

this is strange, whenever we give the fingerprints the prints are QA'ed and the system assigns points the prints. the total points have to exceed a certain number before being accepted. Plus they also clean your fingers before taking a print...
i dont think its a big deal, just give your prints again and follow up with an info pass appointment after a week or so.
I received ANOTHER finger printing notice just for me saying "The FBI was unable process your finger print card. In order for the USCIS to continue processing your application, it will be necessary to have your prints retaken."

about H1, once your current employment is gone, so is your H1. You can not 'transfer' H1 once you have left your job. You will need a new one.

I donot want to discorage you but, I had a similar situation,
As I also has ability to pay RFE and lawyer had sent some papers and I got " A DECISION HAS BEEN MADE AND MAILED TO YOU". It was denial.
You had one choice though. MTO (Motion to reopen)
If your denial is on ability to pay you can send some strong papers. and it will take 6-9 months to get desition mean while you can extend your existing H1 and file another labor.
But if your denial is on education I am not sure how to get approve. I am sure there are ways.
Let me know Once you got papers in your hend I can help you on Ability to pay denial.

I don't want to think and talk about the situation in which I am right now but I have no other choice but to ask for all of you any advise that I can get from you and definitely some words of encouragement. I know that I am in deep trouble but you know that sometimes you don't want to think about it. Any ways here is what happened
I am currently on my 8th year H1 extension which will be expiring in June 2008. I applied for I-140 in February 2007, got a very nasty RFE consists of experience, ability to pay and education. Got 3 months to respond back, replied the RFE on time in October 2007. On 30th November 2007 I got email from USCIS which says that " A DECISION HAS BEEN MADE AND MAILED TO YOU" and does not say specifically that its is a DENIAL or a APPROVAL ,this response is both for I-140 and 485 case. I called my lawyer also and he told me that he cant say anything right now until he receives the paper from USCIS. We are hoping to get the decision paper in mail either on Monday or Tuesday. I think I know what the decision would be but I still would like to cling to light ray of hope here. My labor was filed under EB3.
What if I-140 is denied, what are my options, can I file the I-140 again or what can I do. Please advice , I just cant think at this point. I am just seeing my whole life of 7 years going down the drain.

how do u think BS plus 5 years qualifies as EB2. My attorneys have resopnded back with Labor deptts recommendations and proof from other meetings bwetween AILA and USCIS that it is indeed EB2.
What happens if they still do not like these explainations -
1) Do they send Back another RFE for more proof?
OR
2) Reject the I-140 - in which case I file another I-140 in EB3.
Has anyone had similar experiences?

License can be renewed by mail and expires after 5 years. They dont care about H1 or EAD(atleast not last year .. I renewed my DL in late 2008 when my H1 was expiring in Oct 2009. I got 5 years expiration date)

My company has applied for my GC few years ago when I was a senior programmer, since then I have progressed to be a project Manager and recently to be a Programme Manager.
Question now is - Technically does my GC application still hold water, since the position for which I applied is different than my current position ? I'm still with the same company though.

If I am correct Kumar and Kumari is mostly used by Biharis. Only God knows why they use this.
Inspite of them having a lastname, they go with kumar and kumari... Dont understant why they want to keep in disguise.

I read somewhere that USCIS would not process concurrent filed I-140's until your PD is current. I don't remember the source for this info and will let me dif into it and let you know.

That is not valid becuase they do approve non - concurrent 140 for which labour is filed in '08. And there is no public announcment of such.
