If we assume for a moment that CIR Fails to pass, the scenario will be interesting as you would have an enforcement only bill in House and possibly one of PACE/TALENT OR SKIL bills for supporting highly skilled legal immigrants. Isn't that just about the right solution? What support would these legal immigration bills get in house?

Last Thursday, I came back from India at Chicago POE. There was a separate counter (no secondary check room) at Chicago. I just gave my Passport, AP (2 copies), filled in I-94 form and Customs form. Thst's it no questions asked.

When I know that it is going to take 7-10 years for USCIS to even open my I-485 application for adjudication process in the mean time can I work on EAD in whatever position I want and at the time of adjudication join my employer for this future job (for which I-140 is approved) or if it is available at that time then use AC21 provison and start working as a "Programmer Analyst" for a month or so with this new employer and provide EVL from new job?

The labor at the client I mentioned was paid 15/hr or $30,000/year which is about 15K less than an average engineer graduating from US schools. They know they are underpaid. The discussion came up over lunch when I ask them if they know they are underpaid.
They are also not the best and brightest (which is the intent of the immigration). They are not IIT grads. Most are graduates of cottage education institutions all over India. They come here because it is better than the ghetto... Some grow into the job, some do not.
The Urban Institute study shows that between 1985 and 2000 435,000 U.S. citizens and permanent residents a year graduated with Bachelors, Masters, and Doctoral degrees in Science and Engineering. That's three times the number of jobs in Science and Engineering added per year, 150,000 during that time.
Separately Michael Teitelbaum at the Alfred P. Sloan Foundation told Congress that neither he nor a separate study by the RAND Corporation can find any evidence of worker shortages. These studies are not anomalies.
VIVEK WADHWA, HARVARD UNIVERSITY: Bottom line is that all of our research at Duke and now at Harvard shows the same thing. That there is no shortage of engineers; there's no shortage of scientists. Companies aren't going abroad because of skills. They're going abroad because it's cheaper.
Again, my "anecdotal" discussions are based on studies and observations about what is going on at clients around my major metro area. L1s come in, work for about 6 months and mass layoffs of US citizens occur.

Have you been to Dice.com and seen the number of jobs relative to applicants?

And not all unemployed engineers can do the same work. You have a lot of I-bankers out of work can you hire them to do chip design? I personally know 3 H1 guys who lost job with a couple of weeks, so it is not that H1 guys are not losing there jobs. The economy is bad so there are no takers for the 65000 quota. And those numbers are definitely spooky. You have to really see what all constitutes as Science degrees there. Does it also include biological sciences?

Minimum wage is about $7.25 in NC. I am not talking about the prevailing wage for rocket scientists.
Minimum wage is something the govt. mandates... McDonald cannot get away with paying less than $7.25 per hour.
Isnt there a minimum wage for each job class/type, that is mentioned on your LCA ?
You cannot make the arguement that as a computer programmer you are fine as long as you get 3x what a McDonalds employee gets.:cool:

Hi Folks,
(1) Is there a certain number of years for which an advanced parole given by the USCIS? Or, does it depend on what the applicant is writing, for ex, "I am planning a trip to XXX in between July 1, 2009 through 30 December 2010," and the parole is given on that many years of request?
(2) Also, once an advanced parole expires, should the applicant re-apply it continuosly until he/she receives his/her green card? In case of renewal, should the applicant apply for renewal before a certain number of months before the AP expires.

My wife took her CPA exam in 2002 May in California. She is on H4. So do state to state have different rules or did it get changed now.
Why a SSN is required to do CPA. Even in India CPA courses are conducted and people come here in visitor visa to take the exams. Check with Becker conviser. http://www.beckercpa.com/. My wife started with this institute in India with her CPA before our marriage itself and took the exams after our marriage.

If you wanna hear something REALLY stupid here goes. My wife wants to do her CPA in PA since we are living in PA. But guess what she CANT. Why you ask? Coz to even DO a CPA you need to have a SSN. Yup u guessed it, cant have an SSN if you are on an H4. So now she has to do it in DE becoz of that.
Does anyone know if that is enough grounds to get an SSN? I mean the CPA in PA does not let you even STUDY if you dont have an SSN.
If anyone knows about this issue pls let me know.

Time to squeak boys and girls! I mean we're doing the legal thing side-by-side. Dont you guys think a lil PEACEFUL rally in DC would help? Just banners and walking outside the whitehouse :)
I have said this time and again that we need to take this issue all the way to the top. We have tried individual efforts with senators/congressmen. Some have worked and some havent. Time to get some media coverage that too in the Capital.

I don't see any calculator in the above link. My EB3 PD is June 2003. Anyone has a guess when EB3 would reach that date ?
I am planning on filing new EB2 perm application as I lost hope on EB3 (Employer agreed). Though priority date can be ported over, with the backlogs on PERM process, it looks like it might take anywhere from 6 to 18 months for this process. Do you think moving to EB2 is a wise move ?
Is there any chance that EB3 June 2003 PD will be current before the end of this year ? Any thoughts would probably help in making a decision from my side. Thanks.
Barring a miracle in Sep\Oct there is absolutely no chance that Eb3 will reach June 2003. There are greater chances at end of next year but that are also very low.

Recently our EAD status was updated to Card production ordered. After a week we both received the actual EADs in the mail.
Quite frankly, now we are like "dogs who got whole coconuts". Our long cherised dream has materialized, but can't do anything with it.

let me be clear. I am with my employer now, 140 cleared and 485 pending. I am planning to move to a different company, but they are interested in paying me on 1099 basis. Just wondering if it is OK to work on 1099 or not? My current employer is not going withdraw i140 and my future employer will provide a Employment verification letter if needed. My only concern is can I work on 1099 or not?
