    I bought a REO (bank owned) property a few months ago. I made a 20% down payment. I paid for inspection, etc. myself. Banks usually won't pay for anything and would sell the property AS IS WHERE IS. I did a considerable amount of research ahead of time and my offer reflected it.

    I would suggest to get a really good agent who knows the process and someone you trust to work in your interest. Many agents avoid foreclosures or REOs because it is more work for them and they do not get their full 3% in many cases. Make sure your contract reflects that you are not responsible for any past due taxes, HOA dues, if any, etc. Get the best title insurance that is out there. This is money well spend.

    Unlike usual sales, chances are that you won't find a foreclosed property that is move-in-ready. I spend quite a bit of time before even making an offer. Do your research so that you make a well informed decision. Spend the time upfront so you don't have a "oh shit" moment after you have made an offer and you get the inspection.

    Consider accounting for a seller subsidy in your offer. Usually banks can pay upto 3%, but they will have restrictions on how you can use it. You can make this work to your advantage.

    Find out who the banks or lenders are and their contracts. Make sure you understand the clauses in the contract that will allow you to walk away or when you will lose your earnest money deposit. Typically banks will throw back their own addendum which supersedes everything you have in your contract/proposal, without any flexibility at all to change anything in it. It did not happen in my case, but I have heard that by the time you get their addendum, it is too late to walk away without losing your deposit.

    Getting a loan was another ordeal. Many lenders flatly refused unless I am LPR (green card) or citizen despite having 800+ credit sore and credit history for 10+ years.

    If you are hesitant to spend a few hundred dollars on a property before making an offer, walk away. You are either not serious about it or REO/foreclosures/short sales are not for you.

    There are so many other things. I took me about 3 and a half months from the time I first saw the place and the day I settled. Every day it was a new challenge. Things that I found I have to spend for, hurdles getting a loan, issues with settlement company, things that the lender/settlement company required before settlement that bank won't pay, it went on. Anyway, now when I look back, it was worth it.

    I am in if someone is willing to take it further. As someone pointed out if you look at it from Civil law perspective it makes sense, If you look from Immigration law perspective it may not make sense.......We should consult with some attorneys who have experience with civil lawsuits

    Hi Folks, I am in the process of switching from EB-3 to EB-2 myself. The key to filing EB-2 vs. EB-3 is the qualifications required by the position, NOT the qualifications possessed by the candidate. You might have a Ph.D and 25 years experience, but if you're being hired for a Computer Programmer position, you cannot file EB-2.

    How do you know if your position is EB-2 eligible? You can look on the DoL foreign labor certification website (www.flcdatacenter.org), for your job category, if it says Job Zone 5 or higher, the position qualifies for EB-2. I have heard that certain Job Zone 4 positions have qualified for EB-2, such as "senior software enginer" or "senior systems analyst", however I have been advised by two different lawyers at two different firms that this is not the case.

    You can only amend your I-140, like the previous poster stated, *IF* the original labor certification was for a position that would normally qualify for EB-2 (e.g., "Computer Information Systems Manager" - Job Zone 5) and for some reason your dumbass lawyer filed as EB-3. Otherwise, if your labor certification is for a position that would normally only qualify for EB-3, your employer/sponsor will need to come up with a new position that *does* qualify for EB-2 and then you have to restart the entire process.

    I think H1 to h4 is a normal process...

    But some say we need to have atleast 1/2 paystubs.

    and after changing from h1 to H4, Do we need to wait till we get H4 approval to convert back to h1 if we find any job?

    Hello,

    This is regarding your medical question for Canada PR.

    Just wanted to let you know that even if you got ur medicals done for I-485, you have to get your medicals done again for Canadian PR.

    ************CIC does not accept the 485 medical exam reports****

    I know it involves lot of expenditure again,but thats the way it is!!!:(

    You are pretty close to the finish line of getting your Canada PR...........once your medicals are sent to Ottawa( sent by the doctors directly and u are not given any copy of your medical report).........you should be getting the Passport request and then you have to get ur visa stamped either in person going to your nearest canada embassy or either sending it via post/fedex.

    Guess we posted at the same time. I have lived in both the coasts and have never come across any discrimination, although there are places even in North East where you feel segregated. For example, my wife and I did the mistake of getting into an Italian restaurant in Boston suburb, and we were started at like martians, it was truely a horrible experience. I have no idea about mid-western attitude, from what I heard they are supposed to be damn nice people, but again -- as you say a brown apple always stands out.

    I have lived in midwest for a long time now. Cities and suburbs are fine, if you get into corn land, you will notice. Make sure you stay away from a redneck:cool:

    First of all, sorry for all the insults that you have to face. Some folks here sometimes fight for no valid reason. Unfortunately, some of us are not as broadminded as would except us to be. I apologize for that. Your case certainly is something that most of us cant even imagine.

    Just a thought....may be the couple can move to a state where polygamy is legal and became a resident of that state (Utah?) before they can bring you on-board? Now I don't know how practical this is...just a thought!

    Thanks for your reply.

    Are you saying that I would need all the pay stubs from my employer to prove my status as a legal resident.

    I understand that I can force my employer to pay me, but then he can also fire me, revoke my H1B petition and force me to go back.

    In that case can I maintain my residence solely on the marriage ground ?

    I will eventually get a immigration lawyer to sort this, I am just trying to gather as much info I can so I can make an informed decision.

    I am not sure if this is a troll post or not and I do not care. If you are really looking for an advise here is what you should know

    There is nothing like Bench period when you are on H1. You need to get paid whether you were working on a project or not. You are employed by your employer not by the contracting company where you went on a temporary project.

    It is your right to get paid for the time you were employed by the company A. You are entitled to get paid and get a pay stub. If you have not been paid then you cannot furnish proof that you were in legal status especially if you are on H1.
    1. Speak to your employer and ask for wages for that time and get your back wages paid to you.
    2. If employer does not agree complain to your state DOL about the same. Your employer is legally obligated to pay you.

    About your ability to file your GC using your marriage to a citizen I presume you already have got some advise from learned Attorney.

    Hi,

    I have 3 years of Bachelor's Degree (B.Sc.) My labor was filed showing 6 years of experience. I filed concurrent I-140 and I-485 in August 2007. I am currently working on EAD ( I have completed my 6 years on H1 and there is no extension)

    I received R.F.E. this week on I-140 asking to provide following documents/evidence.

    1. Original complete transcripts and Degree
    2. Original employment verification letters from current and past employers and corroborating evidence of employment experirence in the form of pay stubs or other documentary evidence.
    3. W-2 for the years 2007 and 2008. Current Paystubs.

    My questions are:
    1) If my submit Original transcripts and Degree, when and how do I get it back.
    2) What I need to do if I don't have any experience letter or evidence from one of the past employer.
    3) Can anyone please provide me a template for the employment verification letter. (I had attached experience certificates but they say it does not contain sufficient information)
    4. What are my chances of getting the I-140 approved and options if rejected.

    If you have computer subjects in your 3 year degree, You can notarize your documents. I am thinking that might help you also.

    I don't see any calculator in the above link. My EB3 PD is June 2003. Anyone has a guess when EB3 would reach that date ?

    I am planning on filing new EB2 perm application as I lost hope on EB3 (Employer agreed). Though priority date can be ported over, with the backlogs on PERM process, it looks like it might take anywhere from 6 to 18 months for this process. Do you think moving to EB2 is a wise move ?

    Is there any chance that EB3 June 2003 PD will be current before the end of this year ? Any thoughts would probably help in making a decision from my side. Thanks.

    Barring a miracle in Sep\Oct there is absolutely no chance that Eb3 will reach June 2003. There are greater chances at end of next year but that are also very low.

    Here�s the GC case of my friend whose I-485 got approved in July 2007.

    1. Filed I-485 in July 2004.
    2. Changed employer after 180 days using EAD and never informed USCIS.(Left his GC employer in good terms)
    3. I-485 approved in July 2007.

    As far as i know, USCIS issues an RFE for Employment Verification letter (EVL) just before the adjudication of I-485. But in his case no RFE was issued.

    Is it ok to take this path if we have a good relationship with the previous employer, so as to avoid the hassles of filing AC21? In such a case, can we provide EVL from the previous employer if USCIS issues an RFE?

    It seems that there are about 10 thousand applications that are pending namechecks in the current I485s. Another 15 thousand may become available to qualify in the coming months.

    Pappu, what is the source for this information? 10K and 15K? The USCIS memo mentioned 47K and it is entirely possible that was FB+EB AOS cases.

    Hey guys, I suggest that when we all gather at the Washington monument that we start the rally by all singing the American Anthem, if we'll have a sound system someone with a good voice can lead and we all will join in. Then, as soon as we reach the Capitol we should sing it again! This will show our dedication and love for the U.S. and differentiate us from the illegals. We could also recite the Pledge of Alleigance. We are Future Americans after all! (officially, because we are already Americans in our hearts)

    So then what qualifies as a "different position"?

    It's all depeneds on the Job requirement for the new position. Let's say, you new position is Architect. You could say 4 years Bachelors Degree and progressively earned 5 years exp. Also, you requirment should say out of 5 years, you should have 2 years of development exp and 1 year Tech Lead exp and 2 years of Team lead exp. So, pretty much you progress in your career to become an Architect. If you can prove this with exp letters from your company, you should be able to use you exp from same employer.

    If you get promotion to become an Architect, your case will be strong.

    This is what I summrize from my extensive research on this subject as I am also on the same boat and needs to convince this to my employer/law firm.

    My advice is that talk to your employer and if they agree to file EB2, they will talk to company Lawyers. Your employer will ONLY listen to the Lawyers. However, if you work for a desi company, then its a whole different game and you better of joining a new desi company and file EB2.

    Because your second I-140 was approved without undue delay, my guess is that the "security check" on your first I-140 relates to the employer and not to you. If possible, you should find out if the employer is experiencing delays for other immigration applications. Also, because the I-140 is technically the employer's petition, USCIS will most likely only give information to the employer or the employer's legal representative.

    USCIS IS NOT honouring the 'actual' date we mail it to them. They are receipting it based on when they touch or enter our applications.

    My application reached on Aug 8th, but the receipt date is Sep 19th.

    see your date in SRCxxxx or LINyyyy, the first 4 digits are the date they received.
