SEC. 501. EARNED ACCESS TO LEGALIZATION.
(a) In General- Chapter 5 of title II (8 U.S.C. 1255 et seq.) is amended by inserting after section 245A the following:
`ADJUSTMENT OF STATUS ON THE BASIS OF EARNED ACCESS TO LEGALIZATION
`Sec. 245B. (a) In General- The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien--
`(1) was physically present in the United States for a continuous period of not less than 5 years immediately preceding the date on which this provision was enacted and has maintained continuous physical presence since then;
`(2) has at all times been a person of good moral character;
`(3) has never been convicted of a criminal offense in the United States;
`(4) in the case of an alien who is 18 years of age or older, but who is not over the age of 65, has successfully completed a course on reading, writing, and speaking words in ordinary usage in the English language, unless unable to do so on account of physical or developmental disability or mental impairment;
`(5) in the case of an alien 18 years of age or older, has accepted the values and cultural life of the United States; and
`(6) in the case of an alien 18 years of age or older, has performed at least 40 hours of community service.
`(b) Treatment of Brief, Casual, and Innocent Absences- An alien shall not be considered to have failed to maintain a continuous presence in the United States for purposes of subsection (a)(1) by virtue of brief, casual, and innocent absences from the United States.

`(1) IN GENERAL- The alien shall establish that the alien is admissible to the United States as immigrant, except as otherwise provided in paragraph (2).

Yes, but if ones I-140 is approved by TSC, then since all case information is there at that center, NSC will for sure forward the I-485 to TSC. Also, if it feels it has too much load, then it may forward some of 140 cases approved by them also get routed along with 485 package to TSC.
Actually NSC is the load balancing center. Everything comes there and get routed to TSC depending on case.
There is no clear logic what it sends and when it sends.

A friend of mine got the call the from NBC ( 2007 Filer) with PD as 2005 and he was given the Green Card. Make sure to carry all the documents with you. They won't ask anything but still better to safe than sorry.

Guys
I think my lawyer screwed up he hasnt included my I-140 receipt # with my I-485 even though I gave him, at the time of filing on 7/26/07 my I-140 was still pending but now its approved. The question I have is will USCIS reject my I-485 ? Have included all H1-B, EVL etc.
If they rejecet would I be eligible to file again? What should be my approach?

I have been told two shots are needed besides the regular blood work and
the skin test (and maybe X-ray).
MMR - Measles, Mumps, Rubella vaccine
DPT - Diptheria, Pertussis, Tetanus vaccine
Are there others that are needed?
Also is the Tetanus/Diptheria booster is enough should we take the DPT?

I have had Lingo since 2005 and have never faced any issues with it. Call quality has always been excellent and although their CS used to be pretty horrible, of late it has definitely improved.
I was on the Unlimited USA/Canada plan till late last year when I heard about Unlimited Asia for 29.95 w 2.9c/min to India. I switched over then and they credited the plan change fee of 9.99. Couple of months ago when they launched the Hello World plan for 21.95 w the same 2.9c/min to India I called and switched over and there were no issues. I did have to call once again to get the Plan change fee of 9.99 credited since I think their software applies it automatically but I didnt have any issues.
2 days ago I called to switch over to the Unlimited Plan and it was done, no issues. I probably will have to call after next month's invoice to get the Plan change fee credited.
Overall no issues. Ping me if you need a referral.
Can you answer "tempgc" question that calling from cell phone is allowed by using Lingo account? are you doing it right now? if yes did you see any call quality difference from cell phone to calling from lingo phone directly?

Sorry to rude, but I am not asking individual opinion on this. I am asking Lawyer's educated opinion on this matter. If CIS/State in a hearing in congress confirmed that they have wasted the visas, how are you telling me that they have given all the visas??? Do you have more info than CIS Director???

Would you be kind enough to show where I have written that in my post? If you are a person born in RoW country, one *may* have a case. But if you are born in India/China, then visas issued are more than visa available under 7% quota.

Understand your frustration. But you must have seen what they have done during your first fingerprinting. They do their job to the maximum level. It could have been anything, missing files etc.
If your GC which is going to be issued tomorrow is postponed because of this, then it is an issue. I am sure, it is not the case since you went for finger printing only 3 weeks back, so do what they asked you to do until you get your card. If your PD is somewhere around 2005 or 2006, expect another 6 to 7 more fingerprinting notices before you get your card.

Thanks for the advice pappu. Since I-140 process doesn't require signature or any form from employee(they are asking me to just email some demographic information and send a copy of I-94), how can I make sure the attorney is not missing any required document(s). What are all the required docs for I-140. Can I have the right to ask attorney to provide me the list of docs, just before submission ? So that I can cross check and verify ?

If the attorney is yours and not your employer's, you have all the right to ask him to run all documents by you. If the attorney has been hired by your employer and the employer is paying for the attorney then it is not easy to ask. it depends on your relationship with your HR. I advice my friends in such case to always hire own attorney as a consultant and then ask HR and company lawyer to send you the documents so that you can show to your own attorney for approval. this will also make your company attorney do a better job since his reputation is at stake with another collegue who might pinpoint his mistakes. a company attorney will always work in the interest of the company and your attorney will work in your interest. It is an extra expenditure for you to hire a consultant lawyer, but I think it is worrth it.

I have been interacting with the murthy staff (not the lawyer but other staff members like paralegals, receptionists,client rep, etc. I can say my experience is not that great. They never return your calls. Also I had some queries which they did not clearly answer.

Just to update folks, for 2010 - when properly handled I have seen virtually 100% approvals when there is a 3 year bach + 2 year MA + 5 years of work experience as = MA for EB2. AIME = BA and + 5 years work = MA for EB2. When the PERM requires MA the 3+2 = MA for EB2. A 3 year bach+BED is considered a single source degree for EB2.

In order to have experience and education equating to an advanced degree under section 203(b)(2) of the Act, the beneficiary must have a single degree that is the "foreign equivalent degree" to a United States baccalaureate degree. 8 C.F.R. 5 204.5(k)(2).
In other words, 3 year BSc + 2 Yr MSc can NOT be combined for eb2.

Incorrect!
In order to have experience and education equating to an advanced degree under section 203(b)(2) of the Act, the beneficiary must have a single degree that is the "foreign equivalent degree" to a United States baccalaureate degree. 8 C.F.R. 5 204.5(k)(2).
In other words, 3 year BSc + 2 Yr MSc can NOT be combined for eb2.
