The irony is for I140, TSC is way better than NSC in processing speed....TSC is now churning out Dec 2008/Jan 2009 EB3 applications where NSC is still stuck with July/Aug 2007 applications.... If mine was in TSC, I would have got my I140 app cleared by now.:(
Can't believe it. TSC I-140 EB3 date has been moved back to August 2007. It was March 2008 in last month's update. I wonder when they would make a decision on my petition!!!

Hi Friends,
I recently applied for EAD for my son (10yrs old) and got it couple of days back. I am looking for things to do to obtain a SSN for him? Any guidance please!

Just goto Social Security office fill out the form, take original EAD and passport for the minor and your driving license. They will send the social security number within 2 weeks. I got it for my daughter when we were on EAD. She was 4 yrs old.
Please let me know if you have any question.

I got an excellent performance review.I have a copy of the performance appraisal. so they cannot justify that my performance was not good.

I am going to start looking for jobs now and negotiate that my future employer start the filing process after 90 days if not sooner.

When I contacted for my own case IO mentioned that it takes atleast THREE months to reach my Receipt Date (Sep 18th 2007 according to their website ). He mentioned that at present they are working cases filed on or before 2nd July.
correct..and by that time...ur PD may have retrogressed to 1776...!!!!!!!!!!

Anti american thinks Eb4 is for religious worker and they mainly engaged in worship place so it will not hurt job prospect of american but they are wrong there.. EB4 dependents can work and given GC to them they will start working.
Eb5 creates job for USA so it is out of question for opposition.
I think these two simple reasons allowing them to extend them but they are not getting extended for long term is because of His panic Caucus.
EB5 is easy to understand.
A lot of synagogue hire rabbi from Israel on religious worker category.
Yes Hispanic Caucus is powerful to hold EB2/3 hostage.
....but not powerful enough to take on that lobby.

Hello all,
Maybe this is a common thing- but I wanted to know whether anyone of you have experienced what I have.
Me (secondary applicant) and my wife ( primary) applied for 485 and EAD on July 17th. I live and work in arizona while my wife lives and works in california. We both got all the receipts and also had out FP done. But on friday, the status of my wife EAD was changed to "card production ordered', while nothing has happened to mine. Till now we both have been getting every paper/receipt at the same time even when we are in different states. My question is that being in different states, is it the reason for delay? or is it very common for this short delay in EAD production.
Since i am a secondary applicant, i am in more need for EAD but then USCIS never helps people who are in more need to start with. Will keep hoping they do change their work habbits. Hope to hear from you all....

Hi,
I'm planning to leave my employer but I have'nt completed my 180 days after filling I485. I have filled my I485 on Aug 15 2007 and got receipt date on Oct 20 07. Now I'm planning to go to India for H1b stamping for extension and once I back to US I want to use AC21 and change the employer since he's not paying me my salary. Can anyone please answer following questions
(1)Will 180 days be counted from receipt date or Submitted date.
(2)Can I use AC21 and change my employer before 180 Days?
(3)What is the problem I might going to face with my present employer?
(4) What all the documents I need to secure my GC since he have'nt given any documents for labour and I 485, however I have case nbr for tracking.
Any advise is very valuable.

Coming to the case:
My wife's H4 & I-94 expired on Feb 26th 2007 (Company A). We had applied her extension on May 21st 2007. We couldnt file extension before time as my wife was going thru her pregnancy and child birth. In this process we forgot.
Currently the H4 extension is still pending. When we realised that its too late and thot of sending her to India, we had to wait for approvals our new born son's SSN, US passport, Indian visiting visa and also on the health grounds (vaccinations etc).Now when we got all that, this 485 thing came up which is a big blessing for us.
I have my valid I-797 approval from Comapny B till May'08.
Now for applying 485 for my wife, I heard that we can file under section 245(k) if its still uner 180 days. My wife is still under 180 days. 180th day wud be Aug 23rd. My attorney doesnt have much detailed knowledge about it. Some how I managed to get in touch with her and requested to file under 245(k).
After my long story, Now my questions are :
1. Do we need to explicitly apply under sec 245(k), or if the applicant is out of status her application fall under the 245(k)?
2. If we have to apply under 245(k), what other documents,forms etc do we need?
3. **If my wife's 485 gets filed this week and we get a receipt notice after her 180 days? what wud be the scenario? Does she need to leave the country before 180 days? Can she leave without receipt notice?
4. Assuming my attorney doesnt know how to file under 245(k) and she applies as a normal 485 filing, what wud be the outcome?
These are some of the concerns we both are facing now and having sleepless nites. Can some one pls take some time and advice us. Appreciate it.

180 days is just a guidance. I think its up to the officer handling the case to interpret it. Its always advisable to leave country as soon possible to adjust status. Consult your attorney and file with all kinds of documentation to support your case and hope for the best

There is a concept called Pretrial diversion (PTD) program. I am not sure if it is available in your state. That will avoid any kind of prosecution and judgement and that is what people recommend for immigrants in your situation. I have read about this long ago in immigration-portal forums. Search there and you will find some cases similar to yours and a long discussion on the subject.
