Yes i have been a member since 2006 and yes i dont know much about advocacy and lobbying, but what i do know is that advocacy and lobbying is possible only if you have an organization behind you and in this case EB3 does not believe that the organization named IV is behind them.
Not probabaly but 100 % confirmed that i have never been a donor. Now my questions is why do big companies in USA donate to any party. They do that because they believe that when that party come to power the goverment will be positive towards that specific business. Now what part of the example is not clear to you. EB3 do not donate to IV because they do not believe IV supports EB3 cause. Sure IV says that it is for all EB but the concerns of EB3 get trodden under the general good of EB Community (Read that as EB2)

I think this bill is dead. All the below events are closing up events of the PROJECT CIR. You cannot just let a project die. You need some documents to support your decisions if at all you need to debate on this in future.

Hi all,
We are on the same boat. I'm wondering if there are any successful cases where CSPA and the Patriot Act were combined to ensure that the child remains under 21? My son's name has been deleted from the derivative beneficiary's list, however, he can remain eligible under this I-130 F-4 petition if the Consular calculate his age with Patriot Act 45 days. In that case, he can benefit from CSPA. Our case details as below:

I don�t know if this was just a tit for tat amendment (maybe sessions introduced a anti-immigration amendment and Kerry in retaliation introduced his amendment)

I went to the DC rally anyway...
I meet new friends but cant remember all their unusual names (FBI name check problem :D, just kidding) ...
pose for a picture in front of the US Capitol...
see the White House live!!!...
got inside the US congress buildings (was little embarassed, wearing jeans during lobbying :cool:)...
see old-time friends in DC and have lunch at Chipotle near Tysons Corner mall...
watch some drivers get angry due to the traffic caused by the parade (huh!)...
lost some carbs due to walking, ...
saw nice gals jogging on the streets of DC at the parade route...
5 hours sitting down in the airplane from CA to DC, 5 hours again from DC to CA...
LASTLY, HAPPY JUST BEING THERE FOR THE IV Cause...
P.S. they have good food inside the US congress cafeteria...

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. (Well DOS allocated on 28.6% of total numbers to both this category). This is just my concern on the changes to interpretation for the visa spill over process.

No. Last year we had an RFE as my wife's medicals were missing a signature. As Pappu mentioned in another thread most of them were pre approved and were waiting on visa numbers I think.

Here are my thoughts about May visa Bulletin:
The severe retrogression of EB3 has nothing to do with EB1C (if at all this will affect something, that would be spill over to EB2). This severe retrogression is the result of "FBI name check backlog" being cleared up. We never had actual info as to how many of "super old" cases were pending due to this: Now that they have cleared it up over the past year, it seems to me that it used up most of the visa numbers for EB3 during this fiscal year. This is actually a good news for the people who were waiting for almost a decade, but not so good news for the recent filers.
The main uncertainty is: How many more visa numbers would be needed to actually finish this "name check backlog"...we simply don't know; hopefully not too many.
Impact of this on EB2 would be of similar magnitude and therefore, we can consider that this fiscal year got "almost completely chewed up" in clearing those name check cases. For EB2, actual impact wouldbe apparent (hopefully) in the last quarter when EB2 India an china will move toghether (if the dates are similar like last fiscal year; i.e. 2006, then we can say that it took "year worth of visa numbers" to fix the name check mess. At the same time, some of the effect would be due to EB1C, but I personally have serious doubt that it would have changed much compared to previous years (we will only come to know about EB1C impact once the year end stats will be out and if we see significant change in EB1 usage)..
In any case, "EB2 being current in one year" dream of VDLRAO will not come true (I personally supported this thought last year), mainly because of clearing of FBI name check backlog (which is actually a good thing). One's life time is too short to determine whether changing citizenship to US citizenship is worth or not. And hence to define it as a "wisdom" or "short sightedness" is also almost impossible. Two school of thoughts can just pop up 1) What would be the gain vis a vis loss changing citizenship 2) why one should get rid of the citizenship where one was born. And both of them are more realted with philosophical and moral issues rather than short term material gain...

I accept what you say. But consider this psychological issue: You lived in a country which is 100% different in every thing for most of the life time and then going back after you think to retire. All your kids are either born or grown up here and they no longer wish to come with you when you want to go to your parent country. Again you will be living alone in another country. Instead, we can get our Citizenship and live atleast near our kids. Further, if you are detached with the wordly things and wish to live alone, it is OK.
One more thing, we have come here wantedly without thinking about the future and at all stages of our life we will be confused. I have seen some people with determined mind. They come at the age of 20 - 25, earn a lot, get married to working women, both of them work here , have kids (US citizens), and they go back to their parent country with good money when the kids become 7 years old and both husband and wife will be in the mid of thier carrier. But it is not the case for majority of the people. Many have come with grown up kids etc., and they can not just like that go back. Necessarily they are bound to be here and atleast for those people, to live without anxiety, I would like to have the citizenship process to happen faster if they live here legally for 10 years.

Let me tell one example:
If 2 of our kids are sick , we'll concentrate on both of them for their recovery.If one gets recovered we'll concentrate more on other kid.Now EB2 is in good shape and EB3 is not , now it's time to concentrate more on EB3.
We took both of them to the doctor and the doctors treatment some how is working for only one... even if u change the doctor same thing..

Till early part of 2004 or latter part of 2003, most of the Indians applied EB3 very few applied EB2. After 2004, it was reverse. I doubt any one appled EB3 in 2005 0r 2006.
If EB3 stays continously in 2001 and EB2 in 2004 (there is 3 year difference in cutoff date between EB2 and EB3 now), the guys with EB3 PD 2002 and 2003 will convert to EB2 by applying new 140 to transfer PD. This flow will balance the cut-off dates. Eventually it will reach a common ground or a break-even point.
So, when a 485 is pending, can one file for a new LC (under EB2), I140 and have two GC in progress simutaneously?
